i <br />COMMITTEE OF THE WHOLE MEETING FEBRUARY 8, 1971 <br />ORDINANCE <br />(Cont'd. Public Hearing of 59800 Miami Rd., Scottsdale Mall Zoning) <br />January 20, 1971 <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />The attached rezoning petition of Eugene F. and Mable J. Wilson which was unfavorably recommended <br />to the Common Council on March 31, 1970, and subsequently referred back to the Area Plan Commis- <br />sion for reconsideration was given additional hearing at the January 19, 1971 meeting and the <br />following action was taken: <br />HB:eb <br />After due consideration, it was moved, seconded and carried that <br />this ordinance be returned to the Common Council with an unfavorable <br />recommendation. Mr. Crutchfield abstained from voting. <br />Very truly yours, <br />/s/ Howard Bellinger, <br />Executive Director <br />Mr. Doug Carpenter, Senior Planner, Area Plan Commission explained the Area Plan Commission had <br />made an unfavorable recommendation on the rezoning proposal because the Commission agreed that <br />the commercial area of the mall should not extend south of the by -pass which makes an effective <br />boundary between commercial and residential areas. Councilman Craven noted that the Indiana <br />State Highway Commission had refused to relocate the proposed route of the US #20 by -pass to <br />prevent it from splitting the Scottsdale Mall parking area. (This ordinance was referred back <br />to the Area Plan Commission for further study and final determination of the location of the <br />By -Pass Highway at the May 11, 1970 Council Meeting) Councilman Laven made a motion, seconded by <br />Councilman Craven, that the ordinance go to the Council as unfavorable. Motion carried. 8 ayes, <br />0 nays, 1 absent (Councilman Wise). <br />There being no further business to be considered before the Committee of the Whole, Chairman <br />Grounds entertained a motion to rise and report to the Council.
