COMMITTEE OF THE WHOLE MEETING OCTOBER 13, 1970 <br />ORDINANCE <br />AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, <br />AS AMENDED, COMMONLY KNOWN AS THE ZONING <br />ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA <br />(Chapte_r 40, Municipal Code). AS AMENDED. <br />(Northwest of Intersection of South Bend <br />Avenue and Edison Road, Adjacent to Turtle <br />Creek Apartment Complex) <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Jack C. Dunfee, Jr., attorney, <br />representing the Jackson Realty Company, said the petitioners are seeking to add one building <br />to the already existing development of Turtle Creek Apartment Complex. The petitioner wishes <br />to rezone to multiple - family residential use, a 1.43 acre addition to the Turtle Creek Complex <br />located at Edison and South Bend Avenue. Councilman Laven made a motion to amend the ordinance <br />as follows: <br />In Section I, in the last sentence, change the period (.) to a comma (,) and add <br />the following words "subject to the site plan as finally approved by the Area <br />Plan Commission." <br />Councilman Reinke seconded the motion. Motion carried. 8 ayes, 0 nays, 1 absent. Councilman <br />Reinke made a motion, seconded by Councilman Palmer that the Ordinance go to the Council favorable <br />as amended. Motion carried. 8 ayes, 0 nays, 1 absent. <br />There being no further business to be considered before the Committee of the Whole, Chairman <br />Grounds entertained a motion to rise and report to the Council.
