REGULAR MEETING OCTOBER 13, 1970 <br />REGULAR MEETING <br />OCTOBER 13, 1970 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council <br />Chambers in the County -City Building on Tuesday, October 13, 1970, at 8 :00 p.m. The meeting was <br />called to order by Council President Robert 0. Laven. The invocation was given by Reverend <br />Robert A. MacGill, Dean of the Cathedral of St. James, 117 N. Lafayette Blvd., South Bend, Indiana <br />ROLL CALL <br />PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, <br />Szymkowiak, Palmer and Zielinski. <br />ABSENT: Councilman Wise <br />RESOLVE INTO THE COMMITTEE OF THE WHOLE <br />Council President Laven entertained a motion to resolve the Council into the Committee of the <br />Whole on the state of the City to consider the items listed on the agenda for the consideration <br />of the Committee of.the Whole. Councilman Allen so moved and Councilman Zielinski seconded the <br />motion. Motion carried. Time: 8:07 p.m. <br />II COMMITTEE OF THE WHOLE MEETING <br />Be it remembered that the Common Council of the <br />City building, in the Committee of the Whole, in <br />at 8:08 p.m. The meeting was called to order by <br />11 ORDINANCE <br />City of South Bend, Indiana, met in the County - <br />the Council Chambers on Tuesday, October 13, 1970 <br />Councilman William W. Grounds, who presided. <br />AN ORDINANCE TO APPROPRIATE $22,819.47 FROM <br />THE LOCAL ROAD AND STREET FUND TO THE ACCOUNT <br />"SERVICES CONTRACTUAL ", BEING WITHIN THE LOCAL <br />ROAD AND STREET FUND. <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Lloyd Taylor, City Engineer ex- <br />plained that this amount represents refunds from the state from a two -cent gasoline tax which <br />monies are to be used for street improvements that improve flow of traffic and capacity of street. <br />He explained in detail the construction of each location and in reply to an inquiry from Miss <br />Virginia Guthrie, South Bend Civic Planning Association Executive Secretary, about how the city <br />could spend the money for the projects, already completed, without an appropriation, he said <br />the city already had appropriated funds in the cumulative capital improvement fund. City Control- <br />ler James A. Bickel said the city received an average of $43,000 a month from the state two -cent <br />gasoline tax which is the 7th and 8th cents of the total state gasoline tax. Councilman Szymkow- <br />iak stated that he would like to see the balance of the money for the year used on streets that <br />are badly in need of repair. Councilman Laven made a motion that the ordinance be held in abey- <br />ance with a continuance of the public hearing on October 26, 1970 and that a companion ordinance <br />which appropriates these monies to the various accounts from which they were expended, be drawn <br />up by the City Attorney and Controller and said ordinance be presented to the Council at the <br />October 26th, meeting. Councilman Craven seconded the motion. Motion carried. 8ayes, 0 nays, <br />1 absent. <br />ORDINANCE <br />AN ORDINANCE CREATING A DEPARTMENT OF ECONOMIC <br />DEVELOPMENT TO PROVIDE FOR INDUSTRIAL EXPANSION. <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Robert McGinty, of the South Bend <br />Mishawaka Area Chamber of Commerce Industrial Division stated that a three -man commission would <br />operate the department and that they could issue revenue bonds to finance the construction of <br />industrial buildings which would broaden the city's tax base. He said it doesn't involve tax <br />money from the community. He said the city is the issuing agent through the commission appointed <br />by the Mayor. He further stated that the Commission takes under advisement, contracts with <br />industries and issues bonds in order to provide for facilities to bring that facility to town, <br />therefore,the Commission would consider a number of businesses, both manufacturing and commercial <br />enterprises. Miss Virginia Guthrie, Executive Secretary of the South Bend Civic Planning Assoc., <br />noted that the Civic Planning Association had reviewed the ordinance and are concerned with <br />the responsibility of protecting and helping the present industries that we have now. Mrs. <br />Fredrick Mutzl, 320 Parkovash Avenue objected to the establishment of such a department because <br />of the powers granted to the commission under the Indiana Statute. Councilmen Laven, Craven and <br />Allen agreed the ordinance should be studied more closely. Councilman Laven made a motion that <br />the ordinance be returned to the Ordinance Committee for furthur study and the public hearing <br />be continued, with the recommendation that the Ordinance Committee hold an informal public hear- <br />ing on the ordinance and report back to the Council on or before Nov. 9, 1970. He also recom- <br />mended that members of the Chamber of Commerce be present at the informal public hearing. <br />Councilman Allen seconded the motion. Motion carried. 8 ayes, 0 nays, 1 absent. <br />
