381k - 0 <br />COMMITTEE OF THE WHOLE MEETING JUNE 22, 1970 <br />COMMITTEE OF THE WHOLE MEETING <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee <br />of the Whole in the Council Chambers.of the County -City Building on Monday, June 22, 1970, at <br />8:09 p.m., all members present. The meeting was called to order by Chairman William W. Grounds, <br />who presided. <br />ORDINANCE <br />AN ORDINANCE SUPPLEMENTING ORDINANCE NO. 4268 -59 (Municipal Code <br />Chapter 20) BY ADDING A NEW ARTICLE DEALING WITH VACANT <br />STRUCTURES AND PROVIDING FOR A PENALTY. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents,were given an opportunity to be heard thereon. City Attorney S. J. Crumpacker said <br />this ordinance would make provisions in the City's Municipal Code to cover vacant structures <br />or abandoned buildings which have remained completely or partially open to the public due to <br />negligence of the owner. The these structures are used by trespassers and have become <br />unkempt and unsound and have become nuisances which adversely affect the public health, safety <br />and contribute to the decay of commercial and residential areas. He said the ordinance also <br />provides a penalty if the owner does not comply with the order of the Building Commissioner or <br />Board of Public Works and Safety when notified of the violation of this ordinance. <br />was <br />The motion /made by Councilman Allen, seconded by Councilman Palmer, and carried, to accept the <br />following amendments: (Councilman Laven recommended Amendment #5.) <br />(Amendment #1 <br />Page 2, Sec. 20 -35, line one, after words "entry court; insert "or stairwell" <br />Amendment #2 <br />Page 2, Sec. 20 -35, line three, delete word "four" after words "depth of" and substitute <br />word "two" <br />Amendment #3 <br />Page 3, Sec. 20 -37, final paragraph (c), after the words "Building Commissioner" insert <br />"or of the Board of Public Works and Safety if an appeal is taken" <br />Amendment #4 <br />Page 2, Sec. 20 -35, line one, after the words "Any alcove ", delete word "or" and, insert <br />a comma <br />Amendment #5 <br />Page 2, second paragraph, after the words "public easements ", insert the words "or which <br />might constitute a public hazard to the public easement," <br />Councilman Allen moved to accept Amend. 41r5.. Councilman Craven seconded her motion to accept <br />Amendment #5. Motion carried. <br />Councilman Allen made a motion, seconded by Councilman Zielinski, that the ordinance go to the <br />Council favorable, as amended. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING CHAPTER 9, SECTION 9 -2, <br />ORDINANCE NUMBER 4381 -61, SEC. 1, OF THE MUNI- <br />CIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, <br />PROVIDING FOR THE ADOPTION OF A BASIC BUILDING <br />CODE. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Building Commissioner, Forrest West, <br />explained this ordinance would update the City Building Code to the year 1970. Councilman Palmer <br />made a motion, seconded by Councilman Zielinski that the ordinance go to the Council as favorable. <br />Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING CHAPTER 9, SECTION 9 -3, <br />ORDINANCE NUMBER 4381 -61, ARTICLE 32, SECTION <br />1700.0, OF THE MUNICIPAL CODE OF THE CITY OF <br />SOUTH BEND, INDIANA, PROVIDING FOR THE STAN- <br />DARDS OF ACCEPTED ENGINEERING PRACTICE OF <br />PLUMBING SERVICES GENERALLY. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Building Commissioner, Forrest west, <br />explained this ordinance would update the City Plumbing Code by adopting the Administrative <br />Building Council of Indiana - Plumbing Rules and Regulations - Volume III - 1968. Councilman <br />Allen made a motion, seconded by Councilman Zielinski, that the ordinance go to the Council as <br />favorable. Motion carried. <br />
