'1 <br />COMMITTEE OF THE WHOLE MEETING APRIL 13, 1970 <br />ORDINANCE (Cont'd. Lilac, Darden & Brick Rds.) <br />Eugene Gorbacz, 21317 Mays Drive, South Bend; and Charles L. Schosker, 23381 Adams Road, South <br />Bend. Councilman Allm stated that any petitioner who owns the land has the legal right to ask <br />to be annexed. Attorney William E. Voor, representing the petitioner, Mr. Leo Lippman, an <br />Indianapolis real estate developer, said that his client had no intention of bringing hardship <br />on anyone. He said Mr. Lippman had developed other subdivisions in the city, including River- <br />side Manor, and that sewer and water lines to the proposed annexed area will be installed at the <br />petitioner's cost. He stated that a_ petition to give the tract the required zoning will be <br />filed at a later date. The petitioner, he stated,plans to erect multiple- family apartment <br />houses and some single- family houses. <br />Councilman Craven made a motion that the Ordinance go to the Council as unfavorable. Councilman <br />Palmer seconded the motion. Motion defeated. <br />Councilman Laven made a motion that the Ordinance go to the Council as favorable. Councilman <br />Reinke seconded the motion. Motion carried. <br />There being no further business to be considered before the Committee of the Whole, Chairman <br />Grounds entertained a motion to rise and report to the Council. Councilman Laven so moved, <br />seconded by Councilman Allen. Motion carried. Time: 9:20 p.m. Councilman Laven enter- <br />tained a motion for a short recess.
