341 REGULAR MEETING MARCH 23 1970 PETITIONS (Cont.'d.) 3. A legal description of the property is as follows: Beginning at a point which point is the intersection of the South right -of -way line of Donmoyer Street and the West right -of -way line of High Street; thence westerly along the South right -of- way line of Donmoyer Street a distance of 97.5 feet; thence southerly a distance of 125 feet; thence westerly a distance of 60 feet; thence southerly a distance of 362.5 feet; thence easterly to the west right -of -way line of High Street a distance of 157.5 feet; thence northerly along said west right -of -way line to the place of beginning, a distance of 487.5 feet. 4. It is desired and requested that the foregoing property be rezoned: From "A" Use and "A" Height and Area District To "B" Use and "A" Height and Area District. 5. It is proposed that the property will be put to the following use and the following buildings will be constructed: Multiple family residential - 5 buildings and 24 dwelling units. 6. Number of off street parking spaces to be provided - 24. 7. Councilman Zielinski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE Council - President Laven entertained a motion to waive the reading of the Committee of the Whole Reports. Councilman Zielinski so moved. Councilman Allen seconded the motion. Motion carried unanimously. ORDINANCES, THIRD READING ORDINANCE NO. 5164 -70 AN ORDINANCE PROVIDING FOR THE CREATION OF A POLICE CADET PROGRAM The Ordinance was given third reading. Councilman Zielinski made a motion for passage of the Ordinance. Councilman Reinke seconded the motion. There being no discussion on the motion, the Ordinance was passed by a roll call vote of 9 ayes (Councilmen Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Wise, Palmer and Zielinski) 0 nays. ORDINANCE NO. 5165 -70 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA, AND BADGER METER MANUFACTURING COMPANY, MILWAUKEE, WISCONSIN, FOR THE PURCHASE OF AN ASSORTMENT OF WATER METERS FOR USE FROM FEBRUARY 7, 1970 TO FEBRUARY 7, 1971, IN THE AMOUNT OF $33,926.20. The Ordinance was given third reading. Councilman Craven made a motion for passage of the Ordinance. Councilman Palmer seconded the motion. There being no discussion on the motion, the Ordinance was passed by a roll call vote of 9 ayes (Councilmen Laven, Allen, Craven, Reinke , Grounds, Szymkowiak, Wise, Palmer and Zielinski) 0 nays. ORDINANCE NO. 5166 -70 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA AND HERSEY- SPARLING METER COMPANY, DEDHAM, MASSACHUSETTS, FOR THE PURCHASE OF AN ASSORTMENT OF WATER METERS FOR USE FROM FEBRUARY 7, 1970 TO FEBRUARY 7, 1971, IN THE AMOUNT OF $27,180.20. The Ordinance was given third reading. Councilman Zielinski made a motion for passage of the Ordinance. Councilman Craven seconded the motion.
