32 REGULAR MEETING MARCH 9, 1970 ORDINANCES, THIRD READING ORDINANCE NO. 5161 -70 AN ORDINANCE AUTHORIZING THE TRANSFER OF $1,077.55 FROM THE SANITATION FUND AND $6,780.90 FROM THE MUNICIPAL BONDS OF 1962 FUND TO THE GENERAL SINKING FUND OF THE CITY OF SOUTH BEND, INDIANA. The Ordinance was given third reading. Councilman Grounds made a motion, seconded by Councilman Zielinski, for-passage of the Ordinance. There being no discussion on the motion, the Ordinance passed by a roll call vote of 9 ayes (Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, Wise, Palmer and Zielinski) 0 nays. ORDINANCES, FIRST & SECOND READING ORDINANCE NO. 5162 -70 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAKING OF A TEMPOR- ARY LOAN FOR THE GENERAL FUND AND THE ISSU- ANCE AND SALE OF WARRANTS OF THE CITY FOR SUCH PURPOSE, AS AMENDED. The Ordinance was given first reading by title and second reading in full. Councilman Craven made a motion for suspension of the rules. Councilman Palmer seconded the motion. Motion carried unanimously. City Controller James A. Bickel explained that the money that is usually available from the County Treasurer's Office is not there due to the confusion in the reassess- ment program. He noted that the St. Joseph County Board of Review is still holding hearings on appeals of new real estate assessments, therefore, funds are not available to make tax advances to the City because levies for the various townships have not yet been approved by the Indiana State Board of Tax'Commissioners. Planning (Miss Virginia Guthrie, Executive Secretary of the South Bend Civic/Association, stated this was a very unusual situation because the township trustees were late in getting started on this program. She also said she supported Mr. Bickel on this loan and that he may have to apply for another loan in the near future. Councilman Reinke made a motion that the Ordinance be passed. Councilman Palmer seconded the motion. Motion carried by a roll call vote of 9 ayes (Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, Wise, Palmer and Zielinski) 0 nays, 0 absent.' ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. 4990 - CHAPTER 40 OF THE MUNICIPAL CODE (formerly Zoning Ordinance No. 3702) (Location: 4001 & 4015 South Main Street) (Post Office) The Ordinance was given first reading by title and second reading in full. Councilman Reinke made a motion, seconded by Councilman Palmer, that the Ordinance be set for Public Hearing on March 23, 1970. Motion carried ORDINANCE AN ORDINANCE ALLOWING FUNDS TO BE TEMPORARILY TRANSFERRED FROM THE TRACK ELEVATION FUND TO THE MODEL CITIES FUND. The Ordinance was given first reading by title and second reading in full. Councilman Grounds made a motion, seconded by Councilman Craven that a public hearing be held at a Special Meeting, March 13, 1970 at 8:30 a.m. in the Council Chambers in the County -City Building. Motion carried unanimously. ORDINANCE AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY CONTIGUOUS THERETO. (Location: Lilac, Darden & Brick Roads) The Ordinance was given first reading by title and second reading in full. Councilman Grounds made a motion, seconded by Councilman Craven, that the Ordinance be set for Public Hearing on March 23, 1970. Motion carried.
