32 <br />REGULAR MEETING MARCH 9, 1970 <br />ORDINANCES, THIRD READING <br />ORDINANCE NO. 5161 -70 <br />AN ORDINANCE AUTHORIZING THE TRANSFER OF <br />$1,077.55 FROM THE SANITATION FUND AND <br />$6,780.90 FROM THE MUNICIPAL BONDS OF <br />1962 FUND TO THE GENERAL SINKING FUND OF <br />THE CITY OF SOUTH BEND, INDIANA. <br />The Ordinance was given third reading. Councilman Grounds made a motion, seconded by Councilman <br />Zielinski, for-passage of the Ordinance. There being no discussion on the motion, the Ordinance <br />passed by a roll call vote of 9 ayes (Councilmen Laven, Allen, Reinke, Craven, Grounds, <br />Szymkowiak, Wise, Palmer and Zielinski) 0 nays. <br />ORDINANCES, FIRST & SECOND READING <br />ORDINANCE NO. 5162 -70 <br />AN ORDINANCE OF THE CITY OF SOUTH BEND, <br />INDIANA, AUTHORIZING THE MAKING OF A TEMPOR- <br />ARY LOAN FOR THE GENERAL FUND AND THE ISSU- <br />ANCE AND SALE OF WARRANTS OF THE CITY FOR SUCH <br />PURPOSE, AS AMENDED. <br />The Ordinance was given first reading by title and second reading in full. Councilman Craven <br />made a motion for suspension of the rules. Councilman Palmer seconded the motion. Motion <br />carried unanimously. City Controller James A. Bickel explained that the money that is usually <br />available from the County Treasurer's Office is not there due to the confusion in the reassess- <br />ment program. He noted that the St. Joseph County Board of Review is still holding hearings on <br />appeals of new real estate assessments, therefore, funds are not available to make tax advances <br />to the City because levies for the various townships have not yet been approved by the Indiana <br />State Board of Tax'Commissioners. <br />Planning <br />(Miss Virginia Guthrie, Executive Secretary of the South Bend Civic/Association, stated this was <br />a very unusual situation because the township trustees were late in getting started on this <br />program. She also said she supported Mr. Bickel on this loan and that he may have to apply for <br />another loan in the near future. <br />Councilman Reinke made a motion that the Ordinance be passed. Councilman Palmer seconded the <br />motion. Motion carried by a roll call vote of 9 ayes (Councilmen Laven, Allen, Reinke, Craven, <br />Grounds, Szymkowiak, Wise, Palmer and Zielinski) 0 nays, 0 absent.' <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING <br />ORDINANCE NO. 4990 - CHAPTER 40 OF THE <br />MUNICIPAL CODE (formerly Zoning Ordinance <br />No. 3702) (Location: 4001 & 4015 South <br />Main Street) (Post Office) <br />The Ordinance was given first reading by title and second reading in full. Councilman Reinke <br />made a motion, seconded by Councilman Palmer, that the Ordinance be set for Public Hearing on <br />March 23, 1970. Motion carried <br />ORDINANCE <br />AN ORDINANCE ALLOWING FUNDS TO BE <br />TEMPORARILY TRANSFERRED FROM THE TRACK <br />ELEVATION FUND TO THE MODEL CITIES FUND. <br />The Ordinance was given first reading by title and second reading in full. Councilman Grounds <br />made a motion, seconded by Councilman Craven that a public hearing be held at a Special Meeting, <br />March 13, 1970 at 8:30 a.m. in the Council Chambers in the County -City Building. Motion carried <br />unanimously. <br />ORDINANCE <br />AN ORDINANCE ANNEXING TO THE CITY OF SOUTH <br />BEND CERTAIN TERRITORY CONTIGUOUS THERETO. <br />(Location: Lilac, Darden & Brick Roads) <br />The Ordinance was given first reading by title and second reading in full. Councilman Grounds <br />made a motion, seconded by Councilman Craven, that the Ordinance be set for Public Hearing on <br />March 23, 1970. Motion carried. <br />
