1330 COMMITTEE OF THE WHOLE MEETING MARCH 9, 1970 ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA AND NORTHERN ELECTRIC CONSTRUCTION CO., INC. OF SOUTH BEND, INDIANA FOR THE INSTALLATION OF LIGHTING IN THE AMOUNT OF $4,556.00. This being the time heretofore set for public hearing on opponents were given an opportunity to be heard thereon. explained this contract was for installation of lighting stations, mainly to prevent vandalism. Councilman Reinke Laven that the Ordinance go to the Council as favorable. ORDINANCE the above Ordinance, proponents and - Utilities Director, John Hunter, for some of our City Water pumping made a motion, seconded by Councilman Motion carried. AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. 4990 - CHAPTER 40, OF THE MUNICIPAL CODE (FORMERLY ZONING ORDINANCE NO. 3702) (Location: Elwood, Keller West Side of Bendix Drive, American Legion Post #50), This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. James Reed, American Legion Post Commander of Post #50 said the organization is forced to move out of town because of the downtown renewal program and asked that the Council grant the zoning to make way for a new building. Councilman Szymkowiak made a motion, seconded by Councilman Palmer, that the Ordinance go to the Council as favorable. Motion carried. ORDINANCE AN ORDINANCE AUTHORIZING THE TRANSFER OF $1,077.55 FROM THE SANITATION FUND AND $6,780.90 FROM THE MUNICIPAL BONDS'OF 1962 FUND TO THE-GENERAL SINKING FUND OF THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above Ordinance,jroponents and opponents were given an opportunity to be heard thereon. City Controller James A. Bickel stated that this was the proper procedure to follow when the City wants to retire bonds. Councilman Palmer made a motion, seconded by Councilman Craven, that the Ordinance go to the Council as favorable. Motion carried. Councilman Palmer made a motion for a 5- minute recess. Councilman Zielinski seconded the motion. Motion carried. Time 9:40 p.m. The Council reconvened at 9:45 p.m. nRnTNANC!E AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE 4990 - CHAPTER 40 OF MUNICIPAL CODE (formerly Zoning Ordinance 3702) AS AMENDED. (South side of Edison - West of Hickory). This being the time heretofore set for public hearing on the above Ordinance, proponents and, opponents were given an opportunity to be heard thereon. Attorney George T. Patton, attorney, represented the remonstrators against the 24 units of multiple family public housing units pro- posed on the 2.7 acre Edison Hickory site. He said deeds for lots in the area have restrictive covenants that appear to ban the use of the land for multiple- family public housing structures. Mr. Marty Kleva, representing the D. & L. Development Corp. of Benton Harbor, Michigan stated that the developers would be willing to postpone the public hearing until next week in order to investigate the abstract. .Councilman Laven made a motion, seconded by Councilman Palmer, that subject'to,the` agreement of the petitioner, the Ordinance be delayed pending a final opinion by the City Attorney, Mr. S. J. Crumpacker, on the covenants in the abstract and that the public hearing be continued on March 23, 1970. Motion carried. (This hearing was a continuation of the public hearing held on Feb. 24f 1970) There being no further business to be considered before the Committee of the Whole, Chairman Grounds entertained a motion to rise and report to the Council.
