1330 <br />COMMITTEE OF THE WHOLE MEETING MARCH 9, 1970 <br />ORDINANCE <br />AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER <br />WORKS OF THE CITY OF SOUTH BEND, INDIANA AND NORTHERN <br />ELECTRIC CONSTRUCTION CO., INC. OF SOUTH BEND, INDIANA <br />FOR THE INSTALLATION OF LIGHTING IN THE AMOUNT OF <br />$4,556.00. <br />This being the time heretofore set for public hearing on <br />opponents were given an opportunity to be heard thereon. <br />explained this contract was for installation of lighting <br />stations, mainly to prevent vandalism. Councilman Reinke <br />Laven that the Ordinance go to the Council as favorable. <br />ORDINANCE <br />the above Ordinance, proponents and - <br />Utilities Director, John Hunter, <br />for some of our City Water pumping <br />made a motion, seconded by Councilman <br />Motion carried. <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. <br />4990 - CHAPTER 40, OF THE MUNICIPAL CODE (FORMERLY <br />ZONING ORDINANCE NO. 3702) (Location: Elwood, Keller <br />West Side of Bendix Drive, American Legion Post #50), <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. James Reed, American Legion Post <br />Commander of Post #50 said the organization is forced to move out of town because of the downtown <br />renewal program and asked that the Council grant the zoning to make way for a new building. <br />Councilman Szymkowiak made a motion, seconded by Councilman Palmer, that the Ordinance go to the <br />Council as favorable. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AUTHORIZING THE TRANSFER OF $1,077.55 <br />FROM THE SANITATION FUND AND $6,780.90 FROM THE <br />MUNICIPAL BONDS'OF 1962 FUND TO THE-GENERAL SINKING <br />FUND OF THE CITY OF SOUTH BEND, INDIANA. <br />This being the time heretofore set for public hearing on the above Ordinance,jroponents and <br />opponents were given an opportunity to be heard thereon. City Controller James A. Bickel stated <br />that this was the proper procedure to follow when the City wants to retire bonds. Councilman <br />Palmer made a motion, seconded by Councilman Craven, that the Ordinance go to the Council as <br />favorable. Motion carried. <br />Councilman Palmer made a motion for a 5- minute recess. Councilman Zielinski seconded the motion. <br />Motion carried. Time 9:40 p.m. <br />The Council reconvened at 9:45 p.m. <br />nRnTNANC!E <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE <br />4990 - CHAPTER 40 OF MUNICIPAL CODE (formerly <br />Zoning Ordinance 3702) AS AMENDED. (South side of <br />Edison - West of Hickory). <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and, <br />opponents were given an opportunity to be heard thereon. Attorney George T. Patton, attorney, <br />represented the remonstrators against the 24 units of multiple family public housing units pro- <br />posed on the 2.7 acre Edison Hickory site. He said deeds for lots in the area have restrictive <br />covenants that appear to ban the use of the land for multiple- family public housing structures. <br />Mr. Marty Kleva, representing the D. & L. Development Corp. of Benton Harbor, Michigan stated <br />that the developers would be willing to postpone the public hearing until next week in order <br />to investigate the abstract. .Councilman Laven made a motion, seconded by Councilman Palmer, that <br />subject'to,the` agreement of the petitioner, the Ordinance be delayed pending a final opinion by <br />the City Attorney, Mr. S. J. Crumpacker, on the covenants in the abstract and that the public <br />hearing be continued on March 23, 1970. Motion carried. (This hearing was a continuation of <br />the public hearing held on Feb. 24f 1970) <br />There being no further business to be considered before the Committee of the Whole, Chairman <br />Grounds entertained a motion to rise and report to the Council.
