1 <br />1 <br />COMMITTEE OF THE WHOLE MEETING MAY 12, 1969 <br />Be it remembered <br />of the Whole in <br />members present, <br />and Zielinski. <br />Michigan Street, <br />that the Common Council of the City of South Bend, Indiana met in the Committee <br />the Council Chambers of City Hall on Monday, May 12, 1969, at 8:05 p.m., all <br />Councilmen, Laven, Allen, Craven, Grounds, Szymkowiak ,.Wise, Reinke,-'Palmer <br />The invocation was given by Reverend Jack West, Calvary Temple, 3711 South <br />South Bend, Indiana. <br />ORDINANCE <br />AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND <br />CERTAIN LAND CONTIGUOUS THERETO. <br />(StATE ROAD #23, SOUTH BEND AVE. AND <br />VANESS STREET) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Joseph Black, 18461 State Road <br />#23 objected to the annexation, claiming it has irregular boundaries and that the area already <br />is congested. Mr. Black was speaking for his mother who owns some property An the area. <br />Councilman Laven replied that the annexation was recommended favorably by the Area Plan Commissic <br />and stated that the Council recommended third reading be delayed until May 26, 1969. Councilman <br />Palmer seconded the recommendation. Recommendation carried. <br />ORDINANCE <br />AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF <br />THE CITY OF SOUTH BEND, IDENTIFIED AS ORDINANCE <br />NO. 4990, ORDINANCE NO. 3702, AS AMENDED, TO THE <br />EXTENT IT IS STILL EFFECTIVE, AND THE MUNICIPAL <br />CODE OF SOUTH BEND, INDIANA, SECTIONS 40 -1 TO <br />SECTIONS 40 -43, AS AMENDED, TO THE EXTENT IT IS <br />STILL EFFECTIVE. (LOCATION: MAIN & EWING STREETS) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Attorney Douglas Seeley representing <br />the petitioners, Lyle Burnside and James Locker spoke in favor of the rezoning of the property <br />at Main and Ewing Streets for the erection of a Kroger supermarket. He stated that there will <br />be ample parking and truck dock space and there will be a grassy strip between the sidewalk <br />and the property line. Councilman Craven said the building of the market on this land will be <br />a definite improvement to the area, the land now being vacant. Councilman Reinke made a motion <br />that the Ordinance go to the Council as favorable. Councilman Palmer seconded the motion. <br />Motion carried. <br />
