A 4 <br />R � <br />COMMITTEE OF THE WHOLE MEETING JANUARY 27, 1969 <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE 4990 <br />CHAPTER 40 MUNICIPAL CODE OF THE CITY OF SOUTH BEND, <br />INDIANA. (AN ORDINANCE AFFECTING THE ZONING OF <br />APPROXIMATELY 2.8 ACRES OF LAND, 262.5 FEET EAST AND <br />WEST BY 448 FEET NORTH AND SOUTH LYING APPROXIMATELY <br />290 FEET FROM THE WEST LINE OF IRONWOOD DRIVE, AND <br />172 FEET NORTH OF THE NORTH LINE OF EDISON ROAD, IN <br />THE CITY OF SOUTH BEND, INDIANA.) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Joseph T. Helling, attorney for <br />the petitioner. Mrs. Frances H. Buzby, said a 2'h story brick luxury unit will be developed by <br />the Portage,Realty Company.if the apartment house tract is rezoned from single- family resi- <br />dence use to B- residential or multiple - family use. Mr. Arthur James, 18107 Edison, who lives <br />immediately south of the tract, objected and said a co wenant exists on the property deeds <br />which limits the use of the area to single- family dwelling use. Joseph T. Helling stated <br />that such a restriction was once drafted years ago but the subdivision was never filed as a <br />plat therefore the covenant was not in effect. Mrs. Buzby executed a release of the covenant <br />and Mr. Helling displayed a copy of the release, dated Nov. 19, 1963. The Area Planning <br />Commission reached the same conclusion when it conducted a hearing on the zoning and gave it <br />a favorable recommendation for the rezoning. Councilman Reinke made a motion that the <br />Ordinance go to the Council as favorable. Councilman Palmer seconded the motion. Motion <br />carried. <br />ORDINANCE <br />AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER <br />WORKS OF THE CITY OF SOUTH BEND, INDIANA, AND HERSEY- <br />SPARLING METER COMPANY, DEDHAM, MASSACHUSETTS, FOR <br />THE PURCHASE OF AN ASSORTMENT OF WATER METERS FOR <br />USE FROM FEBRUARY7, 1969 TO FEBRUARY 7, 1970 IN THE <br />AMOUNT OF $56,539.40, AS AMENDED. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Councilman Allen recommended that <br />the date in Section I be amended to read 20th day of January, 1969 instead of 8th day of <br />January, 1969. Councilman Allen made the motion that said date be changed. Motion was seconded <br />by Councilman Szymkowiak. Motion carried. Councilman Laven made the motion that the Ordinance <br />go to the Council as favorableAs Coundednan Szymkowiak seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER <br />WORKS OF THE CITY OF SOUTH BEND, INDIANA, AND BADGER METER MANU- <br />FACTURING COMPANY, MILWAUKEE, WISCONSIN, FOR THE PURCHASE <br />OF AN ASSORTMENT OF WATER METERS FOR USE FROM FEBRUARY 7,1969 <br />TO FEBRUARY 7, 1970 IN THE AMOUNT OF $7,097.30. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Councilman Laven asked how the prices <br />compare with the prices Mr. John Hunter, Superintendent of South Bend Water Works, had last <br />year and years previous. Mr. Hunter replied that prices were lower. Councilman Zielinski <br />made the motion that the ordinance be amended to read in Secti o J 20th, 1969 instead <br />of January 8th, 1969. Motion was seconded by Councilman Allen Coundcii mane Szymkowiak made <br />the motion that Ordinance go to the Council as favorable Counc 1 an Palmer seconded the <br />motion. Motion Carried. <br />s as amenHa. <br />ORDINANCE <br />AN ORDINANCE APPROVING A.- CONTRACT BETWEEN THE WATER <br />WORKS OF THE CITY OF SOUTH BEND, INDIANA, AND GAMON /CALMET <br />METER DIVISION, NEWARK, NEW JERSEY, FOR THE PURCHASE <br />OF AN ASSORTMENT OF WATER METERS FOR USE FROM FEBRUARY <br />7, 1969 TO FEBRUARY 7, 1970 IN THE AMOUNT OF $10,502.20. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Councilman Laven made the motion <br />that the contract be amended to read 20th.J- nu-- 1969 nstead of 8th of January, 1969. <br />Councilman Szymkowiak seconded the motion. C 4ielinski made the motion that the <br />Ordinance go to the Council as favorable, Councilman Szymkowiak seconded the motion. Motion <br />carried. as amended. <br />There being no further business before the Committee of the Whole, Councilman Allen made a <br />motion to rise and report to the Council.
