COMMITTEE:OF THE WHOLE MEETING AUGUST 12, 1968 <br />Be it. remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole <br />in the Council Chambers of City Hall on Monday, August 12, 1968 at 8:08 P.M., nine members present, (Councilmen <br />Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Wise, Palmer, and Zielinski). None absent. The Invocation <br />was given by Councilman Robert 0. Laven. The meeting was called to order by Chairman William W. Grounds, who <br />presided. <br />ORDINANCE <br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO <br />ACCOUNT Q -221, "ELECTRIC SERVICE" IN THE AMOUNT <br />OF $1,100.00 AND TO ACCOUNT Q -.222, "GAS SERVICE" <br />IN THE AMOUNT OF $1,600.00 AND THE TRANSFER OF <br />SAID SUMS FROM ACCOUNT Q -11, "SALARIES" IN THE <br />FIRE DEPARTMENT BUDGET, ALL BEING WITHIN THE <br />GENERAL FUND. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. Speaking for the Ordinance was Fire Chief Cecil McHenry who ex- <br />plained the need for the appropriation was because Station 4 and Station 7 were open until June which was <br />not budgeted. City Engineer Lloyd Taylor said in the 1968 Budget this account was reduced on the basis of <br />the closing of the stations. Councilman Palmer made a motion the Ordinance go to the Council as favorable. <br />Councilman Reinke seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO <br />ACCOUNT MVH -43, "REPAIR PARTS" IN THE AMOUNT OF <br />$9,000 AND THE TRANSFER OF SAID SUM FROM THE <br />FOLLOWING ACCOUNTS: ACCOUNT MVH -11, "SERVICES <br />PERSONAL" $4,200; ACCOUNT MVH -422, "SALT" <br />$2,800 AND ACCOUNT MVH -722, "MOTOR EQUIPMENT" <br />$2,000 AND ALL ACCOUNTS BEING IN THE MOTOR <br />VEHICLE HIGHWAY FUND. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. Speaking for the Ordinance was Street Commissioner Richard Gartner <br />who explained that the money was needed for repairs to equipment and for other materials. The rebuilding of <br />an asphalt refiniser cost $8,O00,which was not counted on in the budget, and three sweeper brooms were needed. <br />Virginia Guthrie, executive secretary of the South Bend Civic Planning Association, questioned if perhaps it <br />would not have been better to get new equipment. Mr. Gartner said a new refinisher would cost approximately <br />$26,000. Councilman Wise asked how long before new equipment needed repairs and was told about three years. <br />Councilman Szymkowiak made a motion the Ordinance go to the Council as favorable. Councilman Laven seconded <br />the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE <br />GENERAL FUND IN THE AMOUNT OF $58,000.00 TO VARIOUS <br />ACCOUNTS WITHIN THE GENERAL FUND, <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. Speaking for the Ordinance was Richard J. Duck, Superintendent of <br />the Municipal Services Facility. He said that when the budget was drawn up for the Municipal Services Facility <br />there was nothing for them to base their figures on. Virginia Guthrie questioned the additional $25,000 <br />for gasoline and said the police mileage was up fifty percent. Mr. Duck explained the police were patrolling <br />more and the price of gasoline had increased. Councilman Laven made a motion to amend item E. Section II <br />to read $500.00 in Account U -37 "Other Supplies ". Councilman Allen seconded the motion. Motion carried. <br />Councilman Laven made a motion the Ordinance go to the Council favorable as amended. Councilman Wise seconded <br />the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING CHAPTER 20, ARTICLE I, <br />OF THE SOUTH BEND, INDIANA, MUNICIPAL CODE, <br />1962. (BOCA Basic Housing Code) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. City Building Commissioner Forrest R. West said South Bend has a <br />Minimum Housing Standard Ordinance and this would be replaced with the Boca Housing Code, which is a nationally <br />recognized code. Speaking against the Ordinance was Councilman Janet S. Allen who felt there were many things <br />in the present code that were not covered in the Boca Housing Code. She also questioned the right of inspection <br />given to the city officials in the proposed code. Councilman Wise moved the Ordinance be referred to Committee <br />for further study. Councilman Allen seconded the motion. Motion carried. Mr. Howard Bellinger, executive <br />director of the South Bend Redevelopment Commission, then told the Council that the new code was essential <br />to recertification of the city's urban renewal programs by federal agencies, and the recertification was now <br />pending until the new code was passed. Councilman Wise made a motion to amend the original motion to read <br />"referred to Committee for further study; >and brought out of Committee for third reading August 26, 1968 ". <br />Councilman Laven seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE DESIGNATING A COMMUNITY ACTION <br />AGENCY FOR THE CITY OF SOUTH BEND, INDIANA <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. City Attorney Arthur Frisk will represent South Bend Community, <br />Attorney Wyatt Mick, the Mishawaka Community, and Mr. Keith Klopfenstein, County Commissioner, St. Joseph County. <br />Mr. Frisk said that leaders of all three political bodies, the county and two cities had agreed to designate <br />ACTION Inc. and that the necessary notices had been given. The designation was the result of the so- called <br />1967 Green amendment to the 1964 Economic Opportunity Act, which provides that governmental agencies can gain <br />some say in the poverty war. The units must designate a private agency and this can be done by executive order <br />or legislative action.. _. <br />
