REGULAR MEETING - RECONVENED

<br />Be it remembered that the Common Council of the City of South Bend, Indiana reconvened its
<br />regular meeting in the Council Chambers of the County -City Building on Tuesday, May 30, 1972 at
<br />8:10 p.m. Themeeting was reconvened by President Peter J. Nemeth who asked that everyone stand
<br />and say the Pledge of Allegiance to the flag.
<br />ROLL CALL PRESENT: Councilmen Serge, Szymkowiak, Miller, Parent, Taylor, Horvath, Newburn
<br />and Nemeth.
<br />ABSENT: Councilman Kopczynski
<br />Council President Nemeth said that the meeting would resume with the Council portion of the
<br />Public Hearing on the Resolution contained in Item #7 on the agenda. Councilman Parent asked
<br />whether any substantial changes were made in the third year plan since the Council reviewed it
<br />at their meeting last week. Mr. Charles Lennon, Executive Director of the Model Cities Program,
<br />said that the MNPA met at 6:00 p.m. this evening and, with 31 members present and voting, voted
<br />to recommend to the Mayor, the Common Council, and HUD the Third Year Comprehensive Plan as
<br />presented to the Council in this resolution. There being no further discussion among the Council
<br />members, Councilman Miller called the question. Councilman Serge made a motion that the resolu-
<br />tion be adopted, seconded by Councilman Szymkowiak, and the motion carried.
<br />RESOLUTION No. 305 -72 A RESOLUTION APPROVING CHANGES IN THE PROGRAM CONTAINED
<br />IN THE SECOND YEAR COMPREHENSIVE PLAN FOR THE CITY
<br />DEMONSTRATION AGENCY.
<br />WHEREAS, the City of South Bend has executed a Grant Agreement with the United States dated
<br />August 3, 1970 under which the United States agreed to assist the city in carrying out its com-
<br />prehensive city demonstration program (Program) and certain projects and activities listed in
<br />the Grant Budget of the Grant Agreement; and
<br />WHEREAS, the Common Council of the City of South Bend, by Resolution No. 272 -71 adopted
<br />April 30, 1971, approved the Second Year Comprehensive Plan under said Grant Agreement; and
<br />WHEREAS, on February 16, 1972, the Model Neighborhood Planning Agency Board adopted certain
<br />amendments to the First Action Year Comprehensive Plan of the Model Cities Program for South
<br />Bend, Indiana; and
<br />WHEREAS, together with said amendments said Board also approved proposedbudgets for the
<br />additional activities contemplated by said amendments, which proposed budgets total $138,437; and
<br />WHEREAS, Mayor Jerry J. Miller has given his approval to said amendments and proposed bud-
<br />gets; and
<br />WHEREAS, there are and will continue to be unexpended and unneeded balances in the funds
<br />earmarked for other programs called for in.said Second year comprehensive plan sufficient to
<br />cover the cost of said proposals; and
<br />WHEREAS, said unexpended balances are in funds made available by the U.S. Department of
<br />Housing and Urban Development (H.U.D.); and
<br />WHEREAS, the Model Neighborhood Planning Agency Board on February 16, 1972, recommended
<br />implementation of these proposals as a budget of $138,437, for the period from January 1, 1972
<br />through August 1, 1972, utilizing the unused H.U.D. funds; and
<br />WHEREAS, the Department of Housing and Urban Development (H.U.D.) in June of 1969 issued a
<br />handbook governing Administrative and Legal Policies and Procedures for the Execution Phase.of
<br />the Model Cities Program, which is identified as CDA Letter No. 8, and further identified as
<br />MCGR 3100.8; and
<br />WHEREAS, according to paragraph 14 b (3) of said CDA Letter No. 8 the addition of a project
<br />or activity costing more than $25,000.00 requires local governing body approval;
<br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana
<br />that:
<br />SECTION 1. The Program is hereby amended to include the material attached hereto and made a part
<br />hereof, which constitutes the revised program and budget for the projects adopted by the Model
<br />Neighborhood Planning Agency Board on February 16, 1972.
<br />SECTION II. The addition in the undertakings to be financed with H.U.D. funds in the amount
<br />of $138,437 in connection with said proposals; as listed in the said attached material is
<br />hereby approved.

<br />A public hearing was held on this resolution at this time. Mr. Lennon said that, because some
<br />Model Cities projects did not start on time and did not spend the amount of money anticipated,
<br />they would now like to make some changes in the budget alignment and would like the Council
<br />to approve the changes which are outlined in the resolution. These changes follow the guidelines
