REGULAR MEETING MARCH 242 1980 <br />COMMITTEE OF THE WHOLE (CONTINUED <br />BILL NO. 25 -80 A BILL AMENDING VARIOUS SECTIONS WITHIN CHAPTER 20, ARTICLE 9 OF <br />THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY <br />KNOWN AS MOBILITY HANDICAPPED PARKING. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponents <br />were given an opportunity to be heard. Council President McGann made the presentation for the bill. <br />He indicated that presently there are five parking spaces in the downtown area designated for <br />the handicapped, and other people are parking in these spaces. He indicated the signs will be <br />redone and bear the wording "Handicapped parking only disabled license or permit required all <br />others will be towed away at owners expense." He said the Council will recommend that the <br />curbs be painted blue. He said angle parking in the garages and surface lots will be 13' wide <br />to allow for ramps. He said there will be a $20 fine and one hour after the ticket has been <br />issued the car may be towed. Mr. Richard Hill, City Attorney, indicated that the mayor whole- <br />heartedly supports these amendments, and the City will do everything it can to enforce any <br />violation. Mr. Gene Wedel, vice president of the Michiana Chapter of the National Spinal Cord <br />Injury Association, thanked the Council and the Mayor for the passage of this bill. Council <br />Member Kopczynski made a motion to pass this bill, as amended, seconded by Council Member Taylor. <br />The motion carried. <br />BILL NO. 20 -80 A BILL AMENDING CHAPTER 2 OF THE MUNICIPAL CODE OF THE CITY OF <br />SOUTH BEND, INDIANA, BY THE INCLUSION OF NEW ARTICLE 17 ENTITLED <br />FIREFIGHTERS AND POLICEMEN'S COLLECTIVE BARGAINING ACT. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponent: <br />were given an opportunity to be heard. Council Member Taylor and Council President McGann, made <br />the presentation for the bill. Council Member Taylor indicated that without a collective bar- <br />gaining bill the Council could go through this confused atmosphere every year. He said the <br />Council was on the eve of negotiations and we have not even made up our minds how it should be <br />handled. He said a resolution is not binding, anduntil this community has a collective bar - <br />gaining bill, this situation could come up again and again. He said there was a public need <br />for collective bargaining. He said until the State law is changed the Council must take the rol- <br />of management. He indicated he would like to amend the bill on page 3, under item ''c" to read: <br />"The President of the Common Council shall select at least two Council Members to participate <br />in the bargaining process. Council Member Serge made a motion to amend, seconded by Council <br />Member Beck. Council Member Kocpzynski indicated that it should be three Council Members, or <br />more. Council Member Serge retracted his motion and changed it to three or more, seconded by <br />Council Member Dombrowski. The motion carried. Mr. George Herendeen, attorney representing <br />the F.O.P., indicated that collective bargaining is not rleaningfulunless it includes binding <br />arbritration. He indicated this bill goes too far when it talks about fringe benefits. He <br />indicated this was something the Council should not handle. He indicated that the bargaining <br />unit should not be limited to sworn police and firemen. He said this bill did not reflect true <br />collective bargaining.' David Kickley, attorney for the firefighters,' indicated he concurred witl <br />remarks made by Mr. Herendeen. He indicated that binding arbritration was the most important <br />thing necessary. He asked that the Council defeat this bill. Council Member Taylor indicated <br />that as long as we have a frozen tax rate and no deficit spending the Council could not really <br />give any serious consideration to binding arbritration. Council Member Dombrowski made a motion <br />to table this bill, seconded by Council Member Voorde. Council Member Serge made a motion to pass.this bill, seconded <br />by Council Member Dombrowski.
