<br />Be it remembered that the Common Council of the City of South Bend met in the Committee of the
<br />Whole on Monday, January 14, 1980, at 7:05 p.m., with eight members present. Chairman
<br />Szymkowiak presiding.
<br />BILL NO. 199 -79 A BILL APPROVING THE FORM AND TERMS OF TRUST INDENTURE AND USER
<br />AGREEMENT, REAL ESTATE MORTGAGE AND INDUSTRIAL DEVELOPMENT REVENUE
<br />BONDS, AND AUTHORIZING THE EXECUTION THEREOF.AND APPROVING RESOLUTION
<br />NO. 40 -79 OF THE SOUTH BEND ECONOMIC DEVELOPMENT COMMISSION RELATING
<br />TO THE SAME COSSMAN AND VIRGINIA COSSMAN PROJECT.
<br />This bing the time heretofore set for public hearing on the above bill, proponents and opponent:
<br />were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Developmel
<br />Commission, made the presentation for the bill. He indicated this $320,000.00 bond issue
<br />would be used for acquisition of real estate and construction of a building located at 2326
<br />Edison Road. He indicated this would be a car wash operation , creating approximately five
<br />new jobs in the Community. Council Member Taylor made a motion to recommend this bill to the
<br />Council favorable, seconded by Council Member Kopczynski. The motion carried.
<br />Council President McGann indicated he had received a letter requesting that the next two bills
<br />be continued until the January 28, 1980 meeting of the Council.

<br />A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK UNDER
<br />ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. 4990 -68, AS AMENDED,
<br />COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND
<br />(NORTH PUMPING STATION.)
<br />BILL NO. 149 -79 A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK UNDER
<br />ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. 4990 -68, AS AMENDED,
<br />COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND
<br />(MORRIS CIVIC.)
<br />Council President McGann made a motion to continue public hearing on these bills until
<br />January 28, 1980, seconded by Council. Member Kopczynski. The motion carried.
<br />BILL NO. 200 -79 A BILL APPROPRIATING $24,000.00 FROM THE FEDERAL ASSISTANCE GRANT,
<br />COMMONLY KNOWN AS GENERAL REVENUE SHARING, TO FUND THE POSITION
<br />OF SAFETY BOARD ASSISTANT, TO BE ADMINISTERED BY THE CITY OF SOUTH
<br />BEND THROUGH ITS DEPARTMENT OF LAW.
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponen-
<br />were given an opportunity to be heard. Mayor Roger Parent made the presentation for the bill.
<br />He indicated that this position was approved by the previous Council, and at that time it was
<br />intended it would be funded with Revenue Sharing moneys. Council Member Kopczynski made a
<br />motion to recommend this bill to theCouncil favorable, seconded by Council Member Taylor. The
<br />motion carried.
<br />BILL NO. 201 -79
<br />A BILL APPROPRIATING $24,100.00 FROM THE FEDERAL ASSISTANCE GRANT
<br />COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR DOG ENFORCEMENT
<br />PERSONNEL, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS
<br />MAYOR'S ACTION CENTER.
<br />Mr. Joseph Kernan, City Controller, indicated that this bill, as well as Bill No. 205 -79, shouli
<br />have public hearing at the same time. Council President McGann made a motion to have public
<br />hearing on Bill No. 205 -79, seconded by Council Member Beck. The motion carried.
<br />BILL NO. 205 -79 A BILL APPROPRIATING $100,000.00 FROM THE FEDERAL ASSISTANCE GRANT,
<br />COMMONLY REFERRED TO AS GENERAL REVENUE SHARING FOR VARIOUS PUBLIC
<br />SAFETY PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH
<br />THE DEPARTMENT OF ADMINISTRATION AND FINANCE.
<br />This being the time heretofore set for public hearing on the above bills, proponents and opponei
<br />were given an opportunity to be heard. Mr. Joseph Kernan, City Controller, made the presenta-
<br />tion for the bills. He indicated that the $24,100 appropriation was.for theCity's own animal
<br />control program and provides the salaries for two dog wardens. He requested that the
<br />$100,000 appropriation be amended to $75,000 to be budgeted over a nine month period. He
<br />indicated this was based on a compromise worked out with the Humane Society. Henry Ferrettie,
<br />County Commissioner, asked how the City was going to provide the service for the other three
<br />months. Mr. Kernan indicated the City would be going into a nine month contract, but would
<br />have an agreement that we could extend it for three months. Mr. James Varga, 1617 S. Taylor,
<br />asked if the Humane Society still charged for picking up animals. Mr. Phillip Snyder,
<br />Director of the Humane Society, indicated that if someone wanted their own dog picked up they
<br />charge $15. Council Member Taylor indicated there was a problem with the City's animal con-
<br />trol program, and the, cost of these two items over the next twelve months could be from
<br />$130,000 to $150,000. He indicated that Mr. Snyder has said that the Humane Society could
<br />handle the entire package for $115,000 a year. He indicated that some of the Council would
<br />be interested in giving the Humane Society a trial by giving them a one year contract with
<br />a stipulation that if at the end of six months the City found that the agency has failed,
<br />the City could get out of the contract. He indicated that Mr. Snyder had agreed that the
<br />Humane Society would provide two vans at all times. Mr. Snyder indicated that the Humane
<br />Society could effectively handle the animal control for the City. He indicated he felt their
<br />Board would approve of the six month stipulation in the contract. Council Member Taylor
<br />indicated that these bills should be continued until the next meeting. He asked the Council
<br />Attorney to assemble the proper wording for a contract with a six month stipulation to
<br />cancel. Richard Hill, City Attorney, indicated there might be a problem with the advertising
<br />if these bills were continued. He indicated that if the City was giving the contract to the
<br />Humane Society there would be a need to amend Bill No. 201 -79 to reflect the salaries of the
<br />two dog wardens from January 2, to February 15. He indicated they could appropriate the
<br />balance of the contract at a later date. He indicated that the salaries should be amended
<br />to $3,200. Council Member Beck asked how long it would take for the Humane Society to obtain
<br />a new van. Mr. Snyder indicated he did not know how long it would take for delivery, but
<br />they would be read to start at once. Council Member Taylor made a motion to amend Bill No.
<br />201 -79 from $24,100 to $3,200 wherever the amount appeared in the bill, seconded by Council
