<br />RESOLUTIONS
<br />Council Member Adams made a motion to have public hearingon resolution 9B before resolution
<br />9A on the agenda, seconded by Council Member Kopczynski. The motion carried.
<br />RESOLUTION NO. 675 -79 A RESOLUTION APPROVING KARL KING HOUSING, INC.
<br />WHEREAS, a shortage of decent, safe and sanitary housing for persons and families of low
<br />income exists in South Bend, Indiana (the "Locality ")
<br />WHEREAS, it is proposed that a multifamily housing project, designated as "Karl King
<br />Towers" be constructed in the Locality (the "Project ") to consist of approximately 219
<br />dwelling units intended for occupancy by persons and families of low income;
<br />WHEREAS, Karl King Housing, Inc. (the "Corporation ") a non- profit corporation, has been
<br />created to provide construction and permanent mortgage financing for the project by the
<br />issuance of its bonds;
<br />WHEREAS, Section 11(b) of the United States Housing Act of,1937 provides for financial
<br />aasistance with respect to housing for persons and families of low income by authorizing an
<br />exemption from federal income taxation for interest paid on bonds issued by certain entities,
<br />such as the Corporation, to assist in the financing of such housing;
<br />WHEREAS, in order to obtain such assistance of the Federal Government, it is necessary
<br />for the Housing Authority of the City of South Bend, Indiana (the "Public Body "), to make
<br />certain determinations and enter into certain agreements with respect to the Project and
<br />the Corporation; and
<br />WHEREAS, in order for the Public Body to make such agreements and enter into such agree-
<br />ments, it is necessary for the governing body which activated the Public Body to approve the
<br />Project:
<br />SECTION I. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
<br />Bend, Indiana, that the Project is hereby approved.
<br />SECTION II. That this Resolution shall be in full force and effect from and after its
<br />adoption by the Common Council and approval by the Mayor.

<br />A public hearing was held on this.resolution at this time. Mr. Kenneth Fedder, attorney re-
<br />presenting Karl King Housing, indicated that Karl King Housing provided residential living
<br />accomodations to the elderly. He said this resolution was a mechanism to use Federal funds
<br />by qualifying them for tax ememption guidelines. Council Member Miller made a motion to
<br />amend the resolution by adding Section I t.o the paragraph Now, therefore, be it resolved by
<br />the Common Council of the City of South Bend, Indiana, that the Project is hereby approved,
<br />and adding a new Section II to read "That this Resolution shall be in full force and effect from
<br />and after its adoption by the Common Council and approval by the Mayor, sec -nded by Council
<br />Member Taylor. The motion carried. Council Member Taylor made a motion to adopt this resolu-
<br />tion, as amended, seconded by Council Member Adams.. The resolution was adopted by a roll call
<br />vote of nine ayes.
<br />RESOLUTION NO. 676 -79
<br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH
<br />BEND, INDIANA, AUTHORIZING THE MAYOR TO SUBMIT TO THE
<br />UNITED STATES GOVERNMENT, DEPARTMENT OF HODUING AND URBAN
<br />DEVELOPMENT, AN APPLICATION FOR 1979 -1981 COMMUNITY DEVELOP-
<br />MENT BLOCK GRANT FUNDS UNDER TITLE I OF THE HOUSING AND
<br />COMMUNITY DEVELOPMENT ACT OF 1977.
<br />WHEREAS, the Mayor of the City of South Bend, Indiana is the Chief Executive Officer of the
<br />City, and is the applicant for.Community Development Block Grant Funds under Title I of the
<br />Housing and Community Development Act of 1977.
<br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, Indiana:
<br />SECTION I. That the Mayor of the City of South Bend,,Indiana, is hereby authorized to
<br />submit the 1979 -1981 Community Development Block Grant Application to the United States Govern-
<br />ment under Title I of the Housing and Community Development Act of 1977.
<br />SECTION II. That the Common Council of the City of South Bend, Indiana, hereby requests
<br />that the Mayor submit the 1979 -1981 Community Development Block Grant application to the Common
<br />Council for review and comment at least two (2) weeks prior to the date upon which the Com-
<br />munity Development Block Grant Application must be filed with the Department of Housing and
<br />Urban Development.
<br />SECTION III. That for every activity, project, or program to be funded under this Resolu-
<br />tion, the Mayor shall submit to the Common Council a line item budget in ordinance form prior
<br />to expenditure of any Community Development Block Grant funds received upon approval of this
<br />application.
<br />SECTION IV. That the Community Development Block Grant application to be developed and
<br />submitted to the Department of Housing and Urban Development, upon approval of this Resolution,
<br />include the following concepts for the Monroe- Sample area:
