REGULAR MEETING NOVEMBER 6 1978 <br />COMMITTEE OF THE WHOLE MEETING (CONTINUED <br />BILL NO. 174 -78 <br />A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY <br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, <br />INDIANA (CHAPTER 21, MUNICIPAL CODE) (2700 LINCOLNWAY WEST.) <br />This being the time heretofore set for public hearing on the above bill, proponents and opponents <br />were given an opportunity to be heard. Mr. Steven Anella, 218 S. Francis, made the presentation <br />for the bill. He indicated this rezoning was being sought for Teachers Credit Union. He asked <br />that the following letter be entered into the record: <br />Area Plan Commission <br />County -City Building <br />South Bend, IN 46601 <br />South Bend <br />County -City <br />South Bend, <br />and <br />City Council <br />Building <br />IN 46601 <br />November 6, 1978 <br />In Re: 2700 Lincolnway West, Rezoning "B" Residential to "Cl Commercial <br />Ladies and Gentlemen: <br />The Teachers Credit Union seeks the rezoning of this property for the purposes of constructing <br />a Service Office. The Teachers Credit Union is appreciative of the fact that the objections <br />to rezoning "Cl" Commercial is not based upon the use to which the Teachers Credit Union intends <br />to place the building, but rather on the justifiable fear that once the property is rezoned to <br />"C 1" Commercial that the Teachers Credit Union could sell the building to anyone in conformity <br />with the "Cl" Commercial rezoning. <br />However, the Teachers Credit Union gives the assurances that the Petition for rezoning is <br />based strictly on the needs of the Teachers Credit Union and not with any intent in the long <br />foreseeable future to sell the building. <br />The Teachers Credit Union has grown over the years from an inconsequential financial institution <br />to one of the major financial institutions in the area. This growth has been occasioned by its <br />services to the membership and the desire of the Teachers Credit Union to acquire this property <br />as a Service Office is based on its desires to fulfill the needs of its membership in the <br />immediate area. It is the present managements' view that the acquisition of this building will <br />fulfill its need to serve its members within the immediate area for a period of at least 20 <br />years. <br />It most certainly, in the view of-the Teachers Credit Union, would be poor policy to expend <br />monies for said building and improvements therein except for over a long term usage of the <br />building and if ever said building is sold, most certainly any sale would adversely affect the <br />neighborhood would therefore adversely affect its members and the Teachers Credit Union. <br />The growth of the Teachers Credit Union has been based on the relation of the services it renders <br />to its members, not only in a financial manner but also in its total effect upon the community. <br />The Teachers Credit Union has in all its actions taken into consideration the interest of the <br />community as evidenced by its care of its facilities, the assistance in the preservation of <br />historical sites and its loan policy. <br />The present hours of the Teachers Credit Union are 9:30 a.m. to 5 :30 p.m. Monday through Friday,,1. <br />assuring the tranquility of the neighborhood and no unusual or noisy activities in the evening. <br />Additionally, the Teachers Credit Union has always sought to cooperate with the municipal <br />authorities to assure a minimal interruption of traffic and to this effect, before any site <br />plan is adopted, the Traffic Engineer of the City of South Bend will be consulted to ensure <br />that the traffic pattern as adopted by the site plan is only after consultation with the <br />Traffic Engineer. <br />Additionally, by filing a site plan, the Teachers Credit Union will be bound by such site plan <br />and if there is any sale in the distant years, such sale shall be controlled by the fact that <br />such purchaser would have to seek a rezoning from "cl" Commercial to "Cl" Commercial, thus <br />giving the Area Plan Commission and the City Council control over any potential buyer in the <br />distant future. <br />It is the intent of the Teachers Credit Union, by this letter, to give assurances that our <br />request is based upon a permanent long -term need and not any sale and that we have a common <br />interest with the neighborhood in preserving the integrity of the neighborhood. <br />Very truly yours, <br />TEACHERS CREDIT UNION <br />W. B. Hawkins <br />President <br />He indicated that Area Plan had made three recommendations and they would conform with their <br />recommendations. Council Member Kopczynski made a motion to recommend this bill to the <br />Council favorable, seconded by Council Member Adams. The motion carried. <br />
