<br />BILL NO. 109 -78
<br />A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY
<br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,
<br />INDIANA (CHAPTER 21, MUNICIPAL CODE) (NORTHEAST CORNER OF
<br />PLEASANT AND IRONWOOD.)

<br />This -being the time heretofore set for public hearing on the above bill, proponents and opponent:
<br />were given an opportunity to be heard. Mr. Charles Sweeney, attorney for the petitioner, made
<br />the presentation for the bill. He indicated this rezoning was being sought in order to build a
<br />convenience shopping area of $5,000 square feet. He indicated that the surrounding area was a
<br />fixed zoning area. Mr. Rick Carey, of the ARea Plan, indicated they had unanimously recommended
<br />denial of this petition, as submitted. He gave the reasons for the denial. Council President
<br />Parent indicated he would be in favor of commercial for this site, if it would be daytime use.
<br />He made a motion to send this back to Area Plan and have them work with the attorney to come up
<br />with something better, insofar as the site plan is.concei ed, seconded by Council Member
<br />Dombrowski. Themotion carried. Mr. Sweeney responded to the Area Plan's objections and in-
<br />dicated they could alter this site plan in order to conform to their objections. Council Member
<br />Miller indicated he thought that this convenience shopping center and bank was the best use for
<br />this land. He asked Mr. McMahon, Director of Public Works, about the ingress and egress. Mr.
<br />McMahon indicated that they had recommended that the ingress and egress be off the alley which
<br />is behind the property. Council President Parent amended his amendment by adding this bill
<br />be continued until the next meeting, September 25, in order for Area Plan and the attorney, as
<br />well as the City Engineer to work something out as far as a new site plan is concerned, seconded
<br />by Council Member Dombrowski. The motion carried.
<br />BILL NO. 167 -78
<br />A BILL APPROPRIATING THE SUM OF $1,687.89 FROM THE CUMULATIVE
<br />SEWER BUILDING AND SINKING FUND TO THE GENERAL IMPROVEMENT
<br />FUND FOR ABSHIRE AND BERKSHIRE DRIVES IN CREST MANOR, SECTION 2.
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent!
<br />were given an opportunity to be heard. Mr. Joseph Nagy, Fiscal Officer, made the presentation
<br />for the bill. He indicated that sanitary sewers were installed on Abshire and Berkshire, as
<br />part of the overall plan to provide sewers to the residents of South Bend at approximately fifty
<br />percent of the cost. He said this appropriation was the City's share of this project. Council
<br />Member Adams made a motion to recommend this bill to the Council favorable, seconded by Council
<br />Member Kopczynski. The motion carried.
<br />BILL NO. 168 -78
<br />A BILL APPROPRIATING THE SUM OF $8,834.34 FROM THE CUMULATIVE
<br />SEWER BUILDING AND SINKING FUND TO THE GENERAL IMPROVEMENT
<br />FUND FOR PROSPECT STREET FROM CALVERT STREET TO DELAWARE STREET.
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent:
<br />were given an opportunity to be heard. Mr. Joseph Nagy, fiscal officer, made the presentation
<br />for the bill. Heindicated that sanitary sewers were installed on Prospect Street, as part of
<br />the overall plan to provide sewers to the residents of South Bend at approximately fifty percent
<br />of this project. He said this appropriation was the City's share of this project. Council
<br />Member Kopdzynski made a motion to recommend this bill to theCouncil favorable, seconded by
<br />Council Member Dombrowski. The motion carried.
<br />BILL NO. 169 -78 A BILL TRANSFERRING THE SUM OF $1,500.00 FROM ACCOUNT NO. 110.0,
<br />SALARIES AND WAGES, REGULAR, TO ACCOUNT NO. 726.0, OTHER EQUIP-
<br />MENT, IN THE AMOUN TOF $1,500.00. ALL ACCOUNTS BEING WITHIN THE
<br />BUREAU OF COMMUNICATIONS BUDGET OF THE GENERAL FUND OF THE CITY
<br />OF SOUTH BEND, INDIANA.
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent!
<br />were given an opportunity to be heard. Mr. Patrick McMahon, Director of Public Works, made the
<br />presentation for the bill. He said this transfer would allow for the purchase of a Dual -trace
<br />Oscilloscope. He said the present scope is old and in poor condition. Council Member Szymkowial
<br />made a motion to recommend this bill to the Council favorable, seconded by Council Member
<br />Kopczynski. The motion carried.
<br />BILL NO. 170 -78
<br />A BILL TRANSFERRING THE SUM OF $3,600.00 FROM ACCOUNT NO. 722.0,
<br />OTHER EQUIPMENT, TO ACCOUNT NO. 260.0, OTHER CONTRACTUALS, IN
<br />THE AMOUNT OF $3,600.00. ALL ACCOUNTS BEING WITHIN THE CITY
<br />ENGINEER BUDGET OF THE GENERAL FUND OF THE CITY OF SOUTH BEND,
<br />INDIANA.
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent!
<br />were given an opportunity to be heard. Mr. Patrick McMahon, Director of Public Works, made the
<br />presentation for thebill. He asked that the bill be amended in the title from Other Equipment
<br />to Motor Equipment. Council Member Kopczynski made a motion to amend this bill, seconded by
<br />Council Member Adams. The motion carried. Mr. McMahon indicated this amount was set aside
<br />for the acquisition of used Police Department vehicles, but due to the fact that they only
<br />traded twelve vehicles during 1978, mechanically sound vehciles were not present in sufficient
<br />numbers to fill this Department's needs. He said he was requesting this transfer to allow
<br />mechanical and body repairs to vehicles in the existing fleet, thus extending the service life
<br />of these vehicles. Council Member Szymkowiak made a motion to recommend this bill to the_Counci:
<br />favorable, as amended, seconded by Council Member Dombrowski. The motion carried.
