REGULAR MEETING JULY 10, 1978 <br />COMMITTEE OF THE WHOLE MEETING (CONTINUED) <br />BILL NO. 97 -78 A BILL APPROVING THE FORM AND TERMS OF LEASE AND TRUST <br />INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND <br />AUTHORIZING THE EXECUTION THEREOF PERTAINING TO GENERAL <br />LIQUORS, INC. <br />This being the time heretofore set for public hearing on the above bill, proponents.and opponents <br />were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Development <br />Commission, made the presentation for the bill. He said this $350,000 bond issue would be used <br />to construct additional facilities for General Liquors, Inc., at 1880 N. Kenmore Street. He said <br />this expansion will mean an increase in employment and it was estimated that approximately eight <br />new jobs will be created. Council Member Szymkowiak made a motion to recommend this bill to the <br />Council favorable,.seconded by Council Member Adams. The motion carried. <br />BILL NO. 83 -78 <br />A BILL APPROPRIATING $5,000.00 FROM THE FEDERAL ASSISTANCE <br />GRANT, COMMONLY KNOWN AS GENERAL REVENUE SHARING, FOR <br />VARIOUS PUBLIC WORKS-:PROGRAMS TO BE ADMINISTERED BY THE CITY <br />OF SOUTH BEND THROUGH ITS DEPARTMENT OF PUBLIC WORKS. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponents <br />were given an opportunity to be heard. Mr. Michael Vance, Deputy Controller, made the presenta- <br />tion for the bill. He said this money would be used to repair the roof at the Municipal Services <br />Facility Building. Council Member Dombrowski made a motion to recommend this bill to the Council <br />favorable, seconded by Council Member Adams. The motion carried. <br />BILL NO. 85 -78 <br />A BILL AMENDING VARIOUS EXISTING SECTIONS OF CHAPTER 20, <br />OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND AND BY <br />THE ADDITION OF ARTICLE 9 MOBILITY HANDICAPPED PARKING. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponents <br />were given an opportunity to be heard. Council President Roger O. Parent, made the presentation <br />for the bill. He indicated that many citizens in our community have become actively involved <br />in assuring that mobility handicapped persons have the opportunity to travel to the from their <br />homes and place of employment. He said that parking has been a problem for our mobility handi- <br />capped, therefore, he was introducing this bill which would enable the Board of Public Works <br />to designate certain "blue curb" areas to be used exclusively for the mobility handicapped person, <br />Council Member Szymkowiak made a motion to recommend this bill to the Council favorable, seconded <br />by Council Member Dombrowski. The motion carried. <br />BILL NO. 96 -78 <br />A BILL AMENDING CHAPTER 16 OF THE MUNICIPAL CODE OF <br />THE CITY OF SOUTH BEND TO ELIMINATE RESTRICTED REFUSE <br />COLLECTORS LICENSES. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponents <br />were given an opportunity to be heard. Mr. Thomas Brunner, City Attorney, indicated he was under <br />the impression that this bill was going to be continued. After a brief discussion it was decided <br />that public hearing would be held on this bill, after which time the Council would decide whether <br />or not to continue public hearing on the bill. Mr. Brunner indicated there was a problem in the <br />City with many trash haulers not having any covering over their trash trucks, and this was creat- <br />ing a health hazard, as well as being unsightly. He said this proposed amendment would eliminate <br />the restricted licenses, and the Administration feels it is a necessary charge, in order to cor- <br />rect the problem. Mrs. Jane Swan, 2022 Swygart, indicated that the City was collecting garbage <br />in open trucks.. Mr. Brunner indicated that the City should adhere to the proposed bill. Mr. <br />Maurice Cohen, 725 E. Eckman, indicated that Park Department rucks pick up leaves and branches <br />with no covering on the trucks and the trash falls out on the street. Rev. Richards, 2221 W. <br />Linden, indicated he was a trash hauler and his truck has passed all standards. He said the <br />small trash haulers could not afford $15,000 for a packer. He indicated he favored covering for <br />the truck, but he would be forced out of business if this bill were passed. Mr. Morris Eggleston, <br />1315 Riding Mall, indicated this bill would put some fine people out of business. He said he <br />failed to see the need for such a stiff ordinance, or one that would put one segment of our citiz( <br />out of work. Mr. Joseph Kelbosits, Manager of the Bureau of Solid Waste, indicated that many <br />of the private haulers do not have licenses. He indicated he was in favor of this bill. Council <br />President Parent made a motion to continue public hearing on this matter until September 25, 1978, <br />seconded by Council Member Dombrowski. The motion carried. Council Member Adams asked Mr. Brunn( <br />for a report on all trash hauler violations since January 1, 1977, and their disposition. <br />BILL NO. 98 -78 <br />A BILL APPROVING A CONTRACT BETWEEN THE BUREAU OF WATER OF THE <br />CITY OF SOUTH BEND, INDIANA, AND (1) CLOW CORPORATION OF SOUTH <br />BEND, INDIANA, AND (2) KENNEDY VALVE MANUFACTURING COMPANY, <br />ELMIRA, NEW YORK, AND (3) MUELLER CO., CHATTANOOGA, TENNESSEE <br />FOR THE PURCHASE OF AN ASSORTMENT OF WATER MAIN, VALVES, <br />FITTINGS AND HYDRANTS IN THE AMOUNT OF $208,268.58. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponents <br />were given an opportunity to be heard. Mr. John Stancati, Director of Utilities, made the pre- <br />sentation for the bill. He said bids were let pursuant to the Statutes of the State of Indiana <br />and were found competitive. Council Member Serge made a motion to recommend this bill to the <br />Council favorable, seconded by Council Member Adams. The motion carried. <br />
