REGULAR MEETING JANUARY 12, 1978 <br />COMMITTEE OF THE WHOLE MEETING <br />BILL NO. 215 -77 A BILL ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS <br />OF SOUTH BEND, INDIANA, CERTAIN LAND LOCATED IN PENN <br />TOWNSHIP, ST. JOSEPH COUNTY, INDIANA. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponent <br />were given an opportunity to be heard. Mr. Robert Parker, Deputy City Attorney, made the presen <br />tion for the bill. He submitted an amendment to Exhibit A and Exhibit B to the petition. Counc <br />Member Miller made a motion to accept these amendments, seconded by Council Member Taylor. The <br />motion carried. Mr. Ed Rabbit, an officer in Edward Rose, the Developer, spoke to the Council <br />regarding his company. He described the proposed apartment complex. Mr. Art Osterwald, of Edwa. <br />Rose, gave an impact statement regarding schools, property values, etc., with respect to their <br />proposed development. Mr. James Groves, attorney representing the Southeast Neighborhood As- <br />sociation, spoke against this annexation. He indicated that if this land was annexed the re- <br />monstrators would possibly file suit. He said that certain requirements for annexation have not <br />been met. Mr. Paul Dits, 17433 Battles Road, spoke against this low rent apartment complex. He <br />indicated the land was too beautiful for this type of complex. Ms. Dianne Matthias, 17700 Irela. <br />Road, spoke against this type of apartment complex. Mr. Richard Gampoli, 59349 Hazel Road, spok <br />against this type of apartment complex. Mr. Richard - Gampoli, 59349 Hazel Road, spoke against <br />this type of apartment complex. Mrs. Marily Ottevaere, 17559 Battles Road., spoke against the <br />annexation and the development. Ms. Andria Waggoner, 17390 Battles Road, spoke against the an- <br />nexation, as well as the development. Mrs. Irene Gammon, City Clerk, indicated that her propert <br />was adjacent to Park Jefferson Apartments and it had not effected the property value of her pro- <br />perty. Mayor Nemeth, spoke in favor of this development in regard to taxation and other advanta <br />the apartment complex will bring to the City. Mr. Mark Toth, 3935 Ironwood, spoke against this <br />development. He said the citizens of South Bend in that immediate neighborhood were also again <br />this development. Mr. Leonard Leffel, 17536 Battles Road, spoke against this annexation, as wel <br />as the development. Mrs. Miller, 17605 Battles Road, spoke against this development, due to the <br />traffic flow in the area. Mr. Ed Mercer, 17599 Battles Road, spoke against this annexation. <br />Mrs. Sallary Vansant, 17450 Ireland, spoke against this apartment complex. Council President <br />Parent indicated that apartment complexes do not bring down property values. Council President <br />Parent made a motion to recommend this bill to the Council favorable, seconded by Council Member <br />Miller. Council Member Kopczynski indicated that the City provides a lot of services for the <br />County residents and they do not contribute to the tax base of the City. Council Member Serge <br />indicated that the apartment complex in the NW area has proved to be an asset to the neighbo <br />hood. Council Member Adams asked if the storm water retention basin was adequate for a project <br />of this size. Mr. McMahon, Director of Public Works, indicated that it was adequate. The motio <br />carried. <br />There being no further business to come before <br />Kopczynski made a motion to rise and report to <br />Dombrowski. SECOND READING <br />ORDINANCE NO. 6289 -78 AN ORDINANCE APPROVING THE FORM AND TERMS OF LEASE <br />AND TRUST INDENTURE AND INDUSTRIAL DEVELOPMENT REVE- <br />NUE BONDS, AND AUTHORIZING THE EXECUTION THEREOF <br />PERTAINING TO THE REAL ESTATE VENTURES PROJECT. <br />This bill had second reading. Council Member Taylor made a motion to pass this bill, seconded <br />by Council Member Kopczynski. The bill passed by a.roll call vote of nine ayes. <br />ORDINANCE NO. 6290 -78 <br />AN ORDINANCE APPROPRIATING $27,425.00 FROM THE <br />FEDERAL ASSISTANCE GRANT COMMONLY REFERRED TO AS <br />GENERAL REVENUE SHARING, FOR VARIOUS LAW ENFORCE- <br />MENT PROGRAMS, TO BE ADMINISTERED BY THE CITY OF <br />SOUTH BEND THROUGH ITS DEPARTMENT OF LAW. <br />This bill had second reading. Council Member Kopczynski made a motion to pass this bill, seco <br />by Council Member Taylor. The bill passed by a roll call vote of nine ayes. <br />ORDINANCE NO. 6291 -78 AN ORDINANCE APPROPRIATING $53,200.00 FROM THE <br />FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS <br />GENERAL REVENUE SHARING FOR VARIOUS PUBLIC SAFETY <br />PROGRAMS TO BE ADMINISTERED BY THE CITY OF SOUTH <br />BEND THROUGH THE DEPARTMENT OF ADMINISTRATION AND <br />FINANCE. <br />This bill had second reading. Council Member Adams made a motion to pass this bill, seconded by <br />Council Member Kopczynski. The bill passed by a roll call vote of nine ayes. <br />s <br />
