REGULAR MEETING JULY 18, 1977 <br />Be it remembered that the Common Council of the City of South Bend met in the Council Chambers <br />of the County -City Building on Monday, July 18, 1977, at 6:00 p.m. Council President Roger 0. <br />Parent presiding. The meeting was called to order, and the Pledge to the Flag was given. <br />ROLL CALL PRESENT: Council Members Serge, Szymkowiak, Miller, Taylor, <br />Kopczynski, Adams, Dombrowski and Parent <br />ABSENT: Council Member Horvath <br />REPORT FROM THE SUB - COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />Your sub - committee on the inspection and supervision of the minutes would respectfully <br />report that it has inspected the minutes of the July 11, 1977 meeting of the Council and <br />found them correct. <br />The sub - committee, therefore, recommends that the same be approved. <br />/s /Roger Parent <br />/s /Mary Christine Adams <br />Council Member Serge made a motion that the minutes of the July 11, 1977, meeting of the Council) <br />be placed on file, seconded by Council Member Adams. The motion carried. <br />Council Member Dombrowski made a motion to resolve into the Committee of the Whole, seconded by <br />Council Member Adams. The motion carried. <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South Bend met in the_- Committee of the <br />Whole on Monday, July 18, 1977, at 6:05 p.m., with eight members present. Chairman pro tem <br />Taylor presiding. <br />BILL NO. 97 -77 <br />A BILL APPROVING THE FORM AND TERMS OF LEASE, MORTGAGE AND <br />TRUST INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, <br />AND AUTHORIZING THE EXECUTION THEREOF PERTAINING TO HENRY <br />EDWARD LOWE. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponent <br />were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Develop- <br />ment Commission, made the presentation for the bill. He said the building would be built on <br />Block Six. He said Lowe, Inc., manufactures clay based products. He said that South Bend would <br />be Lowe's headquarters. He said there will be twelve to fifteen new jobs created, with a pay- <br />roll of $200,000. He introduced Mr. Arthur Perry, corporate attorney for Lowe, Inc., who showed <br />an architectural drawing of the new building. He said that the Economic Development Commission <br />adopted a resolution approving of this funding. Council Member Adams made a motion to recommend <br />this to the Council favorable, seconded by Council Member Dombrowski. The motion carried. <br />BILL NO. 98 -77 A BILL APPROVING THE FORM AND TERMS OF LEASE AND TRUST <br />INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND <br />AUTHORIZING THE EXECUTION THEREOF PERTAINING TO RHOADES- <br />MARTIN ENTERPRISES, INC. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponent <br />were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Developmen <br />Commission, made the presentation for the bill. He said this company is engaged in the business <br />of selling automobile parts, wholesale and retail. He said they plan to establish an auto ser- <br />vice center. He said the Commission adopted a resolution approving this funding. He indicated <br />that members of the organization, together with their attorney, Mr. Richard Kramer, were in the <br />Chambers this evening. He said the facility will be built at 2623 Lincoln Way West. He said <br />they anticipate there will be eight new jobs created. Council Member Kopczynski made a motion <br />to recommend this bill to the Council favorable, seconded by Council Member Adams. The motion <br />carried. <br />BILL NO. 95 -77 <br />A BILL AMENDING CHAPTER 2, ARTICLE 4, SECTION 2 -27, OF <br />THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, <br />COMMONLY REFERRED TO AS PARTICIPATION IN STATE AND <br />FEDERAL PROGRAMS BY REQUIRING APPROVAL OF THE COMMON <br />COUNCIL FOR ALL PARTICIPATION IN SUCH PROGRAMS. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponen <br />were given an opportunity to be heard. Council Member Mary Adams made the presentation for the <br />bill. She said that basically this bill provides that the Council will be notified of all ap- <br />plications for State and Federal funding. She made a motion that the bill be amended, as follow <br />Delete Section I., in its entirety and add the following: SECTION I. Chapter 2, Article 4, <br />Section 2 -27, is hereby amended to read in its entirety as follows: SECTION -2 -27. PARTICIPATIO <br />IN STATE, AND FEDERAL, AND OTHER RELATED PROGRAMS. (a) The City of South Bend through its de- <br />partments, agencies, officers, boards, bureaus, commissions, or any other executive agency there <br />of, are encouraged to utilize to the fullest extent possible all avenues of securing funding fro <br />State, Federal and private sources which would further the effective and efficient operation of <br />their respective offices. (b) No executive agency of the City may participate in, or negotiate <br />and contract for participation in, any State or Federally assisted programs or projects without <br />prior approval of the Mayor and, where required by State or Federal law or regulation, without <br />approval by the Council. (c) all applications or similar forms for which the approval of the <br />Common Council is not required for the participation in any State, Federal or regulation, with- <br />out approval by the Council. (e) All departments, agencies, officers, boards, bureaus, commissions.or any <br />other executive agency of the City receiving funds pursuant to this section shall file written <br />progress reports detailing how the monies are being spent and obligated with the Council during , <br />
