<br />BILL A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED,
<br />COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY
<br />OF SOUTH BEND, INDIANA, (CHAPTER 21, MUNICIPAL CODE)
<br />(4126, 4132, 4136 S. MAIN STREET).
<br />Council Member Miller made a motion to strike this ordinance from the records, in accordance with
<br />the request of the petitioner, seconded by Council Member Dombrowski. The motion carried.
<br />BILL A BILL ZONING A PARCEL OF -LAND WITHIN THE CITY
<br />LIMITS OF SOUTH BEND, INDIANA (Southeast corner
<br />of Chippewa and Michigan Streets).
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponents
<br />were given an opportunity to be heard. Mr. Richard Morgan, attorney, made the presentation for
<br />the ordinance. He indicated this zoning was for Endodontic Services, Inc., a dental clinic.
<br />He indicated that Drs. Feltman and Ma:gers were in the audience, as well as the architect, to answi
<br />any questions the Council might have. He said this property was located at the southeast corner
<br />of Chippewa and U.S. 31. He described the surrounding properties, which are commercial. He in-
<br />dicated this was not a high usage for this property. He said this received a unanimous recom-
<br />mendation from Area Plan. Council Member Serge asked how many parking spaces would be provided.
<br />Mr. Morgan said the petition indicated twenty -four. Council Member Dombrowski asked how many
<br />people would be employed. Mr. Morgan indicated eight. Council Member Kopczynski made a motion
<br />to recommend this bill favorable to the Council, seconded by Council Member Taylor. The motion
<br />carried.
<br />BILL A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED,
<br />COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY
<br />OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE)
<br />(NORTHEAST CORNER OF FILLMORE ROAD(LINDEN AVENUE) AND
<br />CLEMENS STREET).
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponents
<br />were given an opportunity to be heard. Mr. Thomas Brademas, 1614 Devon Circle, made the pre-
<br />sentation for the bill. He indicated that immediately adjacent to the site he was seeking to
<br />have rezoned is the so called Harber Homes. He said he thought the Council was aware of the pro -
<br />blems with these houses. He said his firm had approached HUD with a proposal to acquire, re-
<br />habilitate and manage these homes. He said the Housing Assistance Program has indicated there is
<br />need for 450 housing units for the elderly. He said they propose to develop 121 units, and have
<br />convenience shopping on the site. He said as a companion to this ordinance they have requested
<br />a small amount of rezoning for a development within a single building, and there is a small area
<br />set aside for a convenience grocery. He said it was their plan to have the grocery owned and
<br />operated by the older adults living in the project. He said all buildings will have six units,
<br />they will be one story, brick veneer. He showed a plan of the project to the Council. He said
<br />this was an opportunity to provide older adults with safe and sound housing. Mr. Michael Carring-
<br />ton, Assistant to the Mayor, said that Mr. Brademas had indicated that HUD would approve his pur-
<br />chase of Harber Homes. Mr. Brademas indicated that was essentially correct. He said it must be
<br />put on the open market but all bidders must be willing to take Harber Homes and rehab and manage
<br />it. Mr. Carrington indicated the City's_ primary interest was to get Harber Homes in good condi-
<br />tion. Mr. Brademas indicated that the Council had rezoned the area in question to multi- family
<br />housing and they had submitted an application to HUD, which -was rejected because of Harber Homes.
<br />He said they approached HUD to acquire and rehab Harber Homes, and at the same time develop the
<br />additional housing units for the elderly. He said they could not successfully develop these
<br />homes for the elderly unless Harber Homes was rehabilitated. Council Member Dombrowski indicated
<br />there would be excessive noise in the area from the VFW, the railroad tracks, as well as the
<br />not-s s e and unsafe conditions of LaSalle Park. He indicated this area was one of the poorest for
<br />the elderly. He said he would recommend this to the Council as not favorable. Council Member
<br />Szymkowiak indicated he did not feel the older adults would live there. Council Member Szymkowiak
<br />made a motion to recommend this bill to Council unfavorable, seconded by Council Member Kopczynski
<br />No action was taken on this motion. Council Member Serge asked what the rent would be for these
<br />units. Mr. Brademas indicated $215 to $225 with utilities. He said the rent would be subsidized
<br />and they would only be required to pay rent that would not exceed twenty -five percent of their
<br />income, and some could go as low as fifteen percent. Council President Parent asked the status
<br />of the Block 6 project for senior citizens. Mr. Lloyd Taylor, indicated they had a meeting with
<br />the developers and they think their about thirty days away from closing on this project. Council
<br />President Parent asked if there was any remonstrance to this rezoning in the Area Plan meeting.
<br />Mr. Tony Molnar of Area Plan indicated there was no remonstrance. Council President Parent in-
<br />dicated he thought this bill should be referred to our new Residential Neighborhood Committee for
<br />further study. Council Member Kopczynski indicated that if the Council addressed the problem of
<br />Harber Homes, perhaps they would be in a position to proceed with this project. Mr. Brademas in-
<br />dicated he would be willing to have this rezoning delayed and tied -in with the acquisition and
<br />rehabilitation of Harber Homes. Council Member Kopczynski made a motion that this bill be re-
<br />ferred to the Residential Neighborhood Committee and be set for public hearing and second reading
<br />March 28, 1977, seconded by Council Member Adams. The motion carried.

<br />Council Member Taylor made a motion to refer this bill to the Residential Neighborhood Committee
<br />and set it for public hearing and second reading March 28, 1977, seconded by Council Member
<br />Dombrowski. The motion carried.
