<br />COMMITTEE OF THE WHOLE MEETING
<br />Be it remembered that the Common Council of the City of South Bend met in the Committee of the
<br />Whole on Monday, April 12, 1976, at 7:04 p.m., with nine members present. Chairman Frank Horva
<br />presided.
<br />ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING
<br />CHAPTER 40 OF THE MUNICIPAL CODE OF SOUTH
<br />BEND, INDIANA (723 LAPORTE AVENUE)
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and op-
<br />ponents were given an opportunity to be heard. Mr. James Forrest, 1521 Lincolnway West, made
<br />the presentation for the ordinance. He said Trucut Tool & Supply Co., Inc, planned to use their
<br />existing building at 721 LaPorte Avenue as a warehouse and build a new building at 723 LaPorte
<br />Avenue which would be used as office space. He requested the present zoning be changed to light
<br />industrial.
<br />Council Member Kopczynski made a motion that this ordinance be recommended favorably to the
<br />Council, seconded by Council Member Szymkowiak. The motion carried.
<br />ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
<br />AS AMENDED, COMMONLY KNOWN AS THE ZONING
<br />ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
<br />(CHAPTER 21, MUNICIPAL CODE). (Southwest
<br />corner of South Michigan Street and East
<br />Chippewa, known as Chippewa Knoll).
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and op-
<br />ponents were given an opportunity to be heard. Mr. Tony Molnar, of the Area Plan Commission,
<br />made the presentation for the ordinance. He said basically this was an extension of commerical
<br />uses of this property. He said they were asking for C2 for a shipping center area. Council
<br />Member Horvath said the reason this was on the agenda again was this was handled in two parts,
<br />and this is the second ordinance covering this property.
<br />Council Member Kopczynski made a motion that this ordinance be recommended favorably to the C
<br />seconded by Council Member Taylor. The motion carried.
<br />ORDINANCE AN ORDINANCE FIXING MAXIMUM SALARIES AND
<br />WAGES OF APPOINTED OFFICERS AND EMPLOYEES
<br />OF THE CITY OF SOUTH BEND, INDIANA, WITHIN
<br />THE DIVISION OF COMMUNITY DEVELOPMENT FOR
<br />THE YEAR FROM JULY 1, 1976, TO JUNE 30, 1977.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and op-
<br />ponents were given an opportunity to be heard. Mayor Peter J. Nemeth said he understood Council
<br />might send this ordinance to committee, and he thought this was an excellent idea, and would sug
<br />gest it be referred to committee.
<br />Council Member Horvath said he thought they should hear comments from any one who wished to spea}
<br />to this issue.
<br />Mr. Gene Evans, Executive Secretary of the Civic Planning Association, said he would like to
<br />second the Mayor's request that this be referred to committee. He said he would appreciate more
<br />time to study this proposed ordinance.
<br />Council President Parent made a motion to refer the ordinance to the committee on Administration
<br />and Finance, seconded by Council Member Dombrowski. The motion carried.
<br />ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS
<br />FROM THE GENERAL PARK FUND IN THE AMOUNT OF
<br />$20,000.00 TO ACCOUNTS 252.0 (SERVICES CON-
<br />TRACTUAL, REPAIRS TO EQUIPMENT AND 722.0
<br />(PROPERTIES, MOTOR EQUIPMENT).
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and op-
<br />ponents were given an opportunity to be heard. Mr. James Seitz, Park Superintendent, made the
<br />presentation for the ordinance. He said that because of budget cuts made in 1976, and unexpecte
<br />problems, the Park Department is in a situation where it now needs funds for the efficient opera
<br />tion of the department. He said there was a surplus in the General Park Fund for two reasons;
<br />Controlled spending in the last six months of 1975 to help offset the error made in computing th
<br />amount of State Auto Excise Tax the City would receive in 1975; and an increase in the amount of
<br />miscellaneous receipts that were actually received over the amount that was estimated in 1975.
<br />He said the eighteen year old boiler at Erskine Clubhouse has sprung a leak and cannot be re-
<br />paired and the new boiler will cost $5,000. He said a new filtration system was needed at
<br />Kennedy Pool and that would cost $6,000. He said they needed the following equipment for Erskin
<br />Golf Course: Cushman Truckster or equal, $3,000; greens aerator, $3,400; and a fairway aerator,
<br />$2,100.
<br />Council Member Dombrowski made a motion that this ordinance be recommended favorably to the
<br />seconded by Council Member Kopczynski. The motion carried.
<br />Council Member Horvath asked if the vehicles the police bought to patrol the mall could be con-
<br />verted into park use. Mr. Seitz said he thought those were two wheel hondas and they could not
<br />be used in the parks, and he had been informed that they have been traded in.
<br />There being no further business to come before the Committee of the Whole, Council Member Adams
<br />made a motion to rise and report to the Council, seconded by Council Member Taylor. The motion
<br />carried.
