REGULAR MEETING <br />JULY 14, 1975 <br />REGULAR MEETING - RECONVENED (CONTINUED) <br />REPORT FROM THE AREA PLAN COMMISSION <br />Mr. Roger Parent, President July 3, 1975 <br />The Honorable Common Council <br />City of South Bend <br />County -City Building <br />South Bend, Indiana 46601 <br />In Re: I.P.M. Rezoning - Ironwood and Ireland Roads <br />Dear Mr. Parent: <br />Please be informed that I.P.M.'s petition to rezone the southwest corner <br />of Ironwood and Ireland Roads has been stricken from the Area Plan Commission's agenda. <br />This action was taken at the request of the petitioner, who has now filed a rezoning <br />for this with the St. Joseph County Council. <br />If you have any questions, please call. <br />Very truly yours, <br />RSJ /cm s/ Richard S. Sweeney, Jr. <br />Attorney for T.P.M. <br />Councilman Newburn made a motion to strike the rezoning ordinance referred to in the report from <br />the Council's files, seconded by Councilman Taylor. The motion carried. <br />REPORT FROM THE DIRECTOR OF THE DEPARTMENT OF LAW <br />Mr. James Roemer, Director of the Department of Law, indicated that he had submitted to the Council <br />members two booklets prepared by his department. The first booklet outlined the duties of the <br />legislative and executive branches of government. He stated that the second book contained a few <br />of the opinions he had rendered concerning various issues during the past few years. He indicated <br />that of major concern was an opinion dealing with non - conforming uses in the community. He <br />suggested that one legal intern be hired and his sole function be to handle dog and cat complaints, <br />abandoned vehicles, vacant and substandard buildings and other nuisances and problems of this type. <br />He talked about the strike at Torrington as it involved the city's police department. He felt <br />some policies should be established concerning strike lines and maintenance of order when the proper <br />injunction was filed. He indicated that he would be happy to meet with the Legal Committee for the <br />Council in an effort to better handle the many complaints received by the city. Councilman Nemeth <br />wondered about the status of updating the Municipal Code. He felt that the firm that had submitted <br />the lowest bid should be considered for the updating, and a sample of the page printed by that fir <br />be received so that the project could be started. Mr. Roemer indicated that this would be done <br />and a revenue sharing ordinance could be drafted to cover the cost of the supplements. Councilman <br />Nemeth suggested that this be done as soon as possible. Councilman Szymkowiak indicated that he <br />and Mr. Roemer had observed and viewed many substandard buildings in his district. He stated that <br />nothing had been done as yet concerning demolishment. Mr. Roemer indicated that demolition of <br />buildings take time, and the violations cannot be taken care of overnight. Councilman Szymkowiak <br />indicated that many complaints were never taken care of, and he was concerned about this. Mr. <br />Roemer admitted that a better job would have to be done concerning violations of this kind and he <br />hoped this could be accomplished. <br />PETITIONS TO AMEND ZONING ORDINANCE <br />I (We), the undersigned, do hereby respectfully make application and petition <br />the Common Council of the City of South Bend, Indiana, to amend the Zoning Ordinance <br />of the City of South Bend as hereinafter requested, and in support of this application, <br />the following facts are shown: <br />1. The property sought to be rezoned is located at LaSalle, Niles and <br />Monroe Streets. <br />2. The property is owned by Indiana and Michigan Electric Company. <br />3. A legal description of the property is as follows: <br />Situated in the Township of Portage, County of St. Joseph, and <br />State of Indiana, and known as being the Easterly 218.6 feet <br />of Lots No. 31, 32 and 33, and the Easterly 218.6 feet of a <br />vacated alley located South of and adjacent to Lot No. 33; also <br />Lot No. 34, excepting a parcel 33 feet, north and south, and <br />125 feet east and west, at the Southeast corner of said Lot. <br />Also, all of the East Mill Race being approximately 66 feet east <br />and west, by 198 feet north and south, lying West of and adjacent <br />to Lots 34, 35 and 36; also, an irregular shaped parcel, 58.2 feet <br />along LaSalle Street by 128.5 feet north and south, lying West of <br />the East Mill Race. Also, 7.5 feet of vacated alley located North <br />of and adjacent to the Westerly 110 feet of Lot No. 34, all as <br />shown in the Original Plat of Lowell, Portage Township, Section 12, <br />City of South Bend, Indiana. <br />4. It is desired and requested that the foregoing property be rezoned from <br />"D" Light Industrial Use and "F" Height and Area District, to "A -3" Use <br />and 15 -story Height and Area District. <br />5. It is proposed that the property will be put to the following use and <br />the following building(s) will be constructed: One 15 -story structure <br />containing 225 units for elderly occupancy. <br />
