<br />COMMITTEE OF THE WHOLE MEETING (CONTINUED)
<br />ORDINANCE (CONTINUED) ACCOUNTS BEING WITHIN THE FEDERAL ASSISTANCE
<br />PROGRAM F.A. 75, "CIVIC CENTER CONSTRUCTION ",
<br />TO BE ADMINISTERED BY THE DEPARTMENT OF
<br />PUBLIC WORKS OF THE CITY OF SOUTH BEND,
<br />INDIANA.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard. Mr. Pat McMahon, Manager of the Bureau of Public
<br />Construction, made the presentation for the ordinance. He explained that the ordinance requested
<br />the second and third quarter expense appropriation necessary for payment of the architectural and
<br />construction management fees. He stated that another request for the fourth quarter expenses to
<br />be incurred would be needed sometime in October. He stated that $28,000 was being requested for
<br />the payment of insurance premiums covering the construction phase of the project, which insurance
<br />provided liability and builders risk coverage on the site.
<br />Councilman Nemeth wondered how much had been paid the architect to date, and Mr. McMahon indicated
<br />that, through May 30, 1975, $563,004.52 had been paid. Councilman Horvath wondered how much had
<br />been appropriated from the revenue sharing funds for the project. Mr. McMahon indicated that some
<br />of the funds not used at the end of the year had reverted back to the fund. For this reason, he
<br />could not give an accurate figure. He indicated that there was an approximate amount of
<br />$1,287,000 from revenue sharing funds and approximately $713,000 remained in the funds for the
<br />project.
<br />Councilman Miller made a motion that the ordinance be recommended favorably to the Common Council,
<br />seconded by Councilman Szymkowiak. The motion carried.
<br />ORDINANCE AN ORDINANCE APPROPRIATING THE SUM OF
<br />$85,000.00 FROM THE CUMULATIVE SEWER
<br />BUILDING AND SINKING FUND FOR PROJECT
<br />CS -2, MODEL CITIES SEWER SEPARATION.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard. Mr. Rollin Farrand, Director of the Department
<br />of Public Works, made the presentation for the ordinance. He indicated that, in accordance with
<br />the design contract signed on October 27, 1972, the fee was based on a percentage of the construc-
<br />tion cost. He indicated that the total estimated construction cost of the project was $2,438,913.
<br />and a federal grant of approximately $540,000 had been made available for the construction. He
<br />stated that the fee was estimated at $148,285.93 of which an amount of $66,000 had been previously
<br />paid. He indicated that right -of -way was being purchased and, as of July 11th, three more
<br />properties were needed to complete the purchase.
<br />Councilman Szymkowiak wondered why junk cars were accumulating at the corner of College and
<br />Washington. He stated that these cars were not being removed or towed away. Chairman Newburn
<br />asked that comments be limited to the appropriation request, and Councilman Szymkowiak asked that
<br />the matter be resolved.
<br />Councilman Szymkowiak made a motion that the ordinance be recommended favorably to the Common
<br />Council, seconded by Council President Parent. The motion carried.
<br />There being no further business to come before the Committee of the Whole, Councilman Nemeth made
<br />a motion to rise and report to the Council, seconded by Councilman Horvath. The motion carried.

<br />Be it remembered that the regular meeting of the Common Council of the City of South Bend
<br />reconvened in the Council Chambers at 7:40 p.m., Council President Parent presiding and eight
<br />members present and one member absent (Kopczynski).
<br />REPORT FROM THE SUB - COMMITTEE ON MINUTES
<br />To the Common Council of the City of South Bend:
<br />Your sub - committee on the inspection and supervision of the minutes would
<br />respectfully report that it has inspected the minutes of the June 23, 1975, regular
<br />meeting of the Council and found them correct.
<br />The sub - committee, therefore, recommends that the same be approved.

<br />Councilman Serge made a motion that the report be accepted as read and placed on file and the
<br />minutes be approved, seconded by Councilman Miller. The motion carried.
<br />REPORT FROM THE COMMITTEE OF THE WHOLE
<br />Councilman Newburn made a motion to waive the reading of the report of the Committee of the Whole,
<br />seconded by Councilman Taylor. The motion carried by a roll call vote of eight ayes (Councilmen
<br />Serge, Szymkowiak, Miller, Taylor, Horvath, Nemeth, Newburn and Parent) with Councilman Kopczynski
<br />absent.
