ORDINANCE NO. <br />AN ORDINANCE OF THE COMMON COUNCIL OF <br />THE CITY OF SOUTH BEND, INDIANA, APPROVING <br />PARKIlVG RATES FOR PARKING GARAGES AND PARKIlVG <br />LOTS OPERATED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIANA <br />STATEMENT OF PURPOSE AND INTENT <br />Indiana Code § 36-9-11-7 authorizes the Board of Public Works to fix reasonable rates and <br />charges to be collected for parking vehicles in parking facilities owned and operated by the City and <br />for other use of those parking facilities so as to promote the maximum use of the facilities by the <br />public in a safe, orderly, and efficient manner. Such rates fixed by the Board of Public Works are <br />subject to the approval of the Common Council. The Council has received Resolution No. 3-2003 <br />of the Board of Public Works, a copy of which is attached hereto and incorporated herein, which said <br />Resolution establishes rates for City-owned parking garages. The Common Council finds that these <br />rates are reasonable and are designed to bring in revenue sufficient to cover the cost of providing and <br />operating the parking facilities. <br />NOW, THEREFORE, BE IT ORDAINED bythe Common Council ofthe City of South Bend, <br />Indiana as follows: <br />SECTION I. The following monthlyrates shall be charged for vehicles parked at City operated <br />parking garages: <br />Old New <br />Rate Rate <br />A. Monthly Rate -Standard Parking, Per Vehicle <br />- Month-to-month basis or pursuant to one (1) year contract $ 35.00 $ 40.00 <br />B. Monthly Rate -Premium Parking, Per Vehicle <br />-Month-to-month basis or pursuant to one (1) year contract --------- $ 50.00 <br />* "Premium Parking" shall consist ofnot more than thirty-five (35) spaces located on the 15` and 2nd floors <br />of the two hour free parking areas of each of the following: the Colfax Street, Jefferson Street and Wayne <br />Street Garages AND shall further consist of not more than thirty-five (35) spaces located on the lowest <br />public parking level of the Leighton Plaza Parking Garage. <br />The option to issue or renew agreements for parking inCity-owned and operated garages lies <br />
