Peak, I <br />am withdrawing the proposed ordinance and site development plan of Mrs. <br />Monica M. Peak to zone from "R" Residential to "C -1" Commercial, property <br />located at 1031 Widener Lane in South Bend, Indiana. <br />We are notifying the interested parties who were informed of this ordinance <br />by mail that the above petition is being withdrawn. <br />Yours very truly, <br />(s) Nicholas P. Batteast to <br />zone from "A" Residential, "A" Height and Area, to "B" Residential, "A" <br />Height and Area, property located at the intersection of the 1700 block <br />of North Cushing Street and the 800 block of West Beale Street, specifically <br />the southwest corner, City of South Bend. <br />Gentlemen: <br />The attached rezoning petition of Robert V. Batteast was legally advertised <br />August 10, and August 17, 1974. The Area Plan Commission gave it a public hearing <br />August 20, 1974, at which time the following action was taken: <br />"A motion by Robert Lehman was seconded by Joseph Bajdek to unfavorably <br />recommend the petition of Robert V. Batteast to zone from "A" Residential, <br />"A" Height and Area, to "B" Residential, "A" Height and Area, property <br />located at the intersection of the 1700 block of North Cushing Street and <br />the 800 block of West Beale Street, specifically the southwest corner, <br />City of South Bend, due to the high density and the fact that the proposal <br />is not consistent with the Land Use Plan. <br />Mr. Stonebraker noted the proposed use of the property for multiple <br />dwelling units is not consistent with the recommendations of the Land Use <br />Plan. The subject property has been designated as a residential, low <br />density area. Current zoning maintains this intent. <br />The applicant is proposing a spot utilization of the <br />sistent with the surrounding land uses. The subject <br />on three sides by single family homes. This would be over three times the density of the surrounding <br />single family properties. This also exceeds the highest density yet approved <br />by the Plan Commission; Park Jefferson Apartments has 19 dwelling units per <br />acre and has direct access onto two major streets. The proposed project is <br />only served by minor, residential streets. <br />The staff recommends that the rezoning petition be unfavorably recommended <br />by the Area Plan Commission to the Common Council. <br />Mr. Lehman's motion was then carried unanimously." <br />The deliberations of the Area Plan Commission and points considered in arriving <br />at the above decision are shown in the minutes of that public hearing and will be for- <br />warded to you at a later date to be made a part of this report. <br />cc: Robert V. The motion <br />tarried. <br />
