REGULAR MEETING MAY 10, 1982 <br />BILL NO. 37 -82 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE <br />FIRST EAST -WEST ALLEY SOUTH OF LINCOLNWAY WEST RUNNING EAST <br />FROM RYER STREET TO THE FIRST INTERSECTING NORTH -SOUTH <br />ALLEY FOR A DISTANCE OF 120'; ALL BEING IN BRENTWOOD ESTATES <br />4TH ADDITION TO THE CITY OF SOUTH BEND, INDIANA. <br />Council Member Szymkowiak indicated he had inspected this proposed vacation. He <br />indicated that the closing of this alley block the entrance to.a garage. He in- <br />dicated that the garage was presently not being used as a garage, but as a linen <br />storage, for a motel, however, the owner, Mr. Szabo, wanted to convert it back to a <br />garage. He said that the Council would give Mr. Szabo until August 23, 1982, to <br />convert this area to a garage. He made a motion to continue this bill until August <br />23, seconded by Council Member Taylor. The motion carried. <br />BILL NO.- 42 -82 <br />A BILL AMENDING CERTAIN PORTIONS OF CHAPTERS 13 AND 16 OF <br />THE SOUTH BEND MUNICIPAL CODE, REGULATING NUISANCE AND <br />OTHER OFFENSES. <br />Council Member McGann made a motion to continue public hearing on this bill to May <br />24, 1982, seconded by Council Member Dombrowski. The motion carried. <br />BILL NO. 43 -82 A BILL APPROPRIATING $35,000 FROM THE FEDERAL ASSISTANCE <br />GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING FOR <br />THE SPRING CLEAN -UP PROGRAM FOR 1982 TO BE ADMINISTERED BY <br />THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, IND- <br />IANA. <br />Now is the time heretofore set for public hearing on the above bill proponents and <br />opponents were given an opportunity to be heard. John Leszczynski, Director of <br />Public Works, made the presentation for the bill. He indicated this appropriation <br />would cover a portion of the spring clean -up expense. He indicated they would be <br />coming back to the Council for the balance. Council Member Serge made a motion to <br />recommend this bill to the Council favorable, seconded by Council Member Beck. The <br />motion carried. <br />BILL NO. 44 -82 <br />A BILL TRANSFERRING $1,035,639 AMONG VARIOUS ACCOUNTS, ALL <br />ACCOUNTS BEING WITHIN THE DIVISION OF COMMUNITY DEVELOP- <br />MENT. <br />Now is the time heretofore set for public hearing on the above bill proponents and <br />opponents were given an opportunity to be heard. Jon Hunt, Director of Redevleop- <br />ment, made the presentation for the bill. He indicated this transfer would ac- <br />complish a variety'of functions; annualization of additional budgets, increased or <br />continued funding for high- demand activitie's,'and assist in utilizing funds in the <br />current program year. Council Member Szymkowiak made a motion to recommend this <br />bill to the Council favorable, seconded by Council Member Beck. The motion carried. <br />BILL NO. 45 -82 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING CHAPTER 16, ARTICLE 2, SECTION 16 -8 OF <br />THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, <br />COMMONLY KNOWN AS REFUSE. <br />Council Member McGann made a motion to continue public hearing on this bill until <br />May 24, seconded by Council Member Dombrowski. The motion carried. <br />There being no further business to come before the Committee of the Whole, Council <br />Member Dombrowski made a motion to rise and report to the Council, seconded by Coun- <br />cil member Zielinski. The motion carried. <br />ATTEST: <br />City Clerk <br />,:REGULAR MEETING RECONVENED <br />ATTEST: <br />iairm n <br />Be it remembered that the Common Council of the City of South Bend reconvened in the <br />Council Chambers on the fourth floor of the County- City Building at 7:33 p.m. Coun- <br />cil President McGann presiding and nine members present. <br />BILL, SECOND READING <br />ORDINANCE NO. 7047 -82 <br />AN ORDINANCE CONSENTING TO CERTAIN ACTION APPLICABLE TO THE <br />CITY OF SOUTH BEND ECONOMIC DEVELOPMENT FIRST MORTGAGE REVE- <br />NUE BONDS, SERIES 1980 (TIMBERLINE TRACE PROJECT) AND OTHER <br />DOCUMENTS RELATED THERETO. <br />This bill had second <br />reading. Council Member Serge made a motion to pass this bill, <br />seconded by Council Member Tayor. The bill passed by a roll call vote of nine ayes. <br />ORDINANCE NO. 7048 -82 <br />AN ORDINANCE AMENDING AN ORDINANCE ENTITLED: "AN ORDINANCE <br />AUTHORIZING THE ISSUANCE AND SALE NOT EXCEEDING $4,000,000.00 <br />OF REVENUE BONDS OF THE CITY OF SOUTH BEND, INDIANA, FOR THE <br />PURPOSE OF MAKING A LOAN TO HEALTH QUEST REALTY V, IN ORDER <br />TO FINANCE THE ACQUISITION AND CONSTRUCTION OF CERTAIN ECONOMIC <br />DEVELOPMENT FACILITIES LOCATED IN ST. JOSEPH COUNTY, INDIANA, <br />TO BE USED AND OCCUPIED BY FOUNTAINVIEW PLACE CORPORATION OF <br />SOUTH BEND; AUTHORIZING EXECUTION OF TRUST INDENTURE AND <br />FINANCING AGREEMENT; PROVIDING FOR THE DELIVERY OF AN FHA - <br />INSURED MORTGAGE NOTE AS SECURITY FOR SAID BONDS; AND AUTHORIZI <br />THE TERMS AND SALE OF SAID BONDS ". <br />
