<br />that the Common Council of the City of South Bend met in the Commit -
<br />on May 10, 1982, at 7:03 p.m., with nine members present. Chairman
<br />A BILL AUTHORIZING THE ISSUANCE AND SALE OF $350,000
<br />ECONOMIC DEVELOPMENT REVENUE BONDS OF THE CITY OF SOUTH
<br />BEND, INDIANA, FOR THE PURPOSE OF MAKING A LOAN TO MEDICAL,
<br />ARTS CORPORATION OF SOUTH BEND, AN INDIANA CORPORATION, IN
<br />ORDER TO FINANCE THE CONSTRUCTION AND EQUIPPING OF CERTAIN
<br />ECONOMIC DEVELOPMENT FACILITIES LOCATED IN SOUTH BEND, INDIANA:
<br />AUTHORIZING EXECUTION OF A LOAN AGREEMENT: PROVIDING FOR THE
<br />DELIVERY OF A NOTE AND ASSIGNMENT THEREOF AS SECURITY FOR
<br />SAID BONDS; AUTHORIZING AN INDENTURE OF TRUST APPROPRIATE
<br />FOR THE PROTECTION AND DISPOSITION OF THE REVENUES FROM SUCH
<br />NOTE.
<br />Council Member Taylor made a motion to continue this bill indefinitely, seconded by
<br />Council Member Dombrowski. The motion carried.
<br />BILL NO. 40 -82
<br />A BILL CONSENTING TO CERTAIN ACTION APPLICABLE TO THE CITY
<br />OF SOUTH BEND ECONOMIC DEVELOPMENT FIRST MORTGAGE REVENUE
<br />BONDS, SERIES 1980 (TIMBERLINE TRACE PROJECT) AND OTHER
<br />DOCUMENTS RELATED THERETO.
<br />Now is the time heretofore set for public hearing on the above bill proponents and
<br />opponents were given an opportunity to be heard. Kenneth Fedder, attorney for the
<br />Economic Development Commission, made the presentation for the bill. He indicated
<br />this bill is requesting the City to approve the transfer of the interest of Timber-
<br />line Trace Partnership and the assignment and assumption of that bond obligation. He
<br />indicated that the trustee and the bondholders have all approved this procedure.
<br />Council Member McGann made a motion to recommend this bill to the Council favorable,
<br />seconded by Council Member Taylor. The motion carried.
<br />BILL NO. 41 -82 A BILL AMENDING AN ORDINANCE ENTITLED: "AN ORDINANCE AUTHORIZING
<br />THE ISSUANCE AND SALE NOT EXCEEDING $4,000,000.00 OF REVENUE
<br />BONDS OF THE CITY OF SOUTH BEND, INDIANA, FOR THE PURPOSE OF
<br />MAKING A LOAN-TO HEALTH QUEST REALTY V, IN ORDER TO FINANCE
<br />THE ACQUISITION AND CONSTRUCTION OF CERTAIN ECONOMIC DEVELOPMENT
<br />FACILITIES LOCATED IN ST. JOSEPH COUNTY, INDIANA, TO BE USED
<br />AND OCCUPIED BY FOUNTAINVIEW PLACE CORPORATION OF SOUTH
<br />BEND; AUTHORIZING EXECUTION OF TRUST INDENTURE AND FINANCING
<br />AGREEMENT; PROVIDING FOR THE DELIVERY OF AN FHA - INSURED
<br />MORTGAGE NOTE AS SECURITY FOR SAID BONDS; AND AUTHORIZING
<br />THE TERMS. AND SALE OF SAID BONDS ".
<br />Now is the time heretofore set for public hearing on the above bill proponents and
<br />opponents were given an opportunity to be heard. Kenneth Fedder, attorney for the
<br />Economic Development Commission, made the presentation for the bill. He indicated He
<br />indicated that on August 24, 1981, the Council passed Ordinance No. 6954 -81 which
<br />authorized the sale of bonds not to exceed $4,000,000. He indicated that because of
<br />increases in the market interest rates it was necessary to increase the amount of the
<br />bonds to $4,500,000, with an interest rate of 14 1 /2s. Council Member Szymkowiak
<br />made a motion to recommend this bill to the Council favorable, seconded by Council
<br />Member Serge. The motion carried.
<br />BILL NO. 2 -82 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY
<br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,
<br />INDIANA (CHAPTER 21, MUNICIPAL CODE)(217 -223 E. OHIO.)
<br />Now is the time heretofore set for public hearing on the above bill proponents and
<br />opponents were given an opportunity to be heard. Larry Magliozzi, representative of
<br />Area Plan, indicated that their Commission had given a favorable recommendation to
<br />this rezoning. Mr. Joseph Kerwin, a representative of St. Vincent DePaul, made the
<br />presentation for the bill. He indicated they were planning to expand their present
<br />facilities. Glendarae Hernandez, 702 E. South, spoke against this rezoning. Council
<br />Member Taylor made a motion to recommend this bill to the Council favorable, seconded
<br />by Council Member Szymkowiak. The motion carried.
<br />Council Member McGann made a motion to have combined public hearing on the next two
<br />bills, seconded by Council Member Dombrowski. The motion carried.

<br />A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK
<br />UNDER ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. 4990 -
<br />68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF
<br />THE CITY OF SOUTH BEND (314 WEST LASALLE.)
<br />BILL NO. 31 -82 A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK
<br />UNDER ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. 4990 -
<br />68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF
<br />THE CITY OF SOUTH BEND (233 NORTH LAFAYETTE.)
<br />Now is the time heretofore set for public hearing on the above bill proponents and
<br />opponents were given an opportunity to be heard. John Oxian, Vice President of the
<br />Historic Preservation Commission, made the presentation for the bills. He indicated
<br />that the Commission recommended both of these sites as historic landmarks. He in-
<br />dicated they could easly be put on the national register. He gave a brief history
<br />of the buildings. Council Member Serge made a motion to recommend these bills to
<br />the Council favorable, seconded by Council Member Dombrowski. The motion carried.
