F8 , <br />REGULAR MEETING APRIL 26 1982 <br />WHEREAS, Section 11(b) of the United States Housing Act of 1937 provides that <br />interest paid on obligations issued by certain entities, such as the Corporation, to <br />assist in financing of housing, such as the Project, are tax - exempt, and the same <br />section authorizes an exemption from taxation for income derived by such entities <br />from such housing; <br />WHEREAS, in order to obtain the tax exemption benefits of federal law, it is <br />necessary for the Housing Authority of the City of South Bend, Indiana (the "Author- <br />ity") to make certain findings and enter into certain agreements with respect to the <br />Project and the Corporation, which findings and agreements are set out in substant- <br />ially the form of the Resolution attached hereto as Exhibit I; and <br />WHEREAS, in order for the Housing Authority of the City of South Bend, Indiana <br />tomake such findings, enter into such agreements and engage in trasactions contem- <br />plated by Exhibit I attached hereto, as Exhibit I; and <br />WHEREAS, in order for the Housing Authority of the City of South Bend, Indiana <br />to make such findings, enter into such agreements and engage in trasactions contem- <br />plated by Exhibit I attached hereto, it is necessary, pursuant to Burns Indiana <br />Statutes Section 36- 7- 18 -14, for the Common Council of South Bend, Indiana, the gov- <br />erning body which activated the Authority, to approve the Project; <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, that: <br />SECTION 1. The Project is hereby approved. <br />SECTION 2. The adoption by the Authority of a Resolution, in substantially the <br />same for as Exhibit I attached hereto, is approved. <br />SECTON 3. The Authority's transactions contemplated by the Resolution, attached <br />hereto as Exhibit I, are approved. <br />SECTON 4. This Resolution shall be in full force and effect from the date of <br />its passage, signing and attestation. <br />Lewis A. William Voor, attorney for <br />the Housing Authority, indicated the Housing Authority had adopted a resolution ap- <br />proving this project. He indicated this project would be similar to the Karl King <br />Towers. Council Member Szymkowiak made a motion to adopt this resolution, seconded <br />by Council Member Beck. The resolution was adopted by a roll call vote of nine ayes. <br />BILLS, FIRST READING <br />BILL NO. 37 -82 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE <br />FIRST EAST -WEST ALLEY SOUTH OF LINCOLNWAY WEST RUNNING <br />EAST FROM RYER STREET TO THE FIRST INTERSECTING <br />NORTH -SOUTH ALLEY FOR A DISTANCE OF 120'; ALL <br />BEING IN BRENTWOOD ESTATES 4TH ADDITION TO <br />THE CITY OF SOUTH BEND, INDIANA. <br />This bill had first reading. Council Member Beck made a motion to suspend the rules <br />and have public hearing and second reading on this bill, seconded by Council Member <br />Taylor. The motion carried on a roll call vote of nine ayes. Now is the time here- <br />tofore set for public hearing on the above bill, proponents and opponents were given <br />an opportunity to be heard. Mardelle DeLanghe, 1240 Ryer St., the petitioner, made <br />the presentation for the bill. She indicated they wanted this alley vacated, since <br />it was not used, and they presently maintained it. Thomas Szabo, 3310 Lincolnway <br />West, spoke against the closing of this alley, indicating it would deny him entrance <br />to a garage. John Leszczynski, Director of Public Works, indicated there was access <br />from the north -south alley. Council Member Dombrowski made a motion to continue this <br />public hearing in the Council portion, until May 10, and refer it to the Residential <br />Neighborhood Committee, seconded by Council Member Crone. The motion carried. Coun- <br />cil Member Beck indicated there will be a committee meeting May 10, at 6:00 p.m. <br />BILL NO. 38 -82 <br />A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING VARIOUS SECTIONS OF CHAPTER 4 OF THE MUNI- <br />CIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY <br />KNOWN AS LICENSES, AND BY THE ADDITION OF SECTION 4 -20 EN- <br />TITLED AUTOMOBILE BODY REPAIR /USED CAR DEALERS AND SECTION <br />4 -31 ENTITLED IMPOUNDED MOTOR VEHICLE STORAGE BUSINESSES. <br />This bill had first reading. Council Member Dombrowski made a motion to set this <br />bill for public hearing and second reading June 14, 1982, seconded by Council Member <br />Beck. The motion carried. <br />
