<br />FEBRUARY 8, 1982
<br />Be it remembered that the Common Council of the City of South Bend met in the Council
<br />Chambers of the County -City Building on Monday, February 8, 1982, at 7:00 p.m. The
<br />meeting was called to order and the Pledge to the Flag was given.
<br />ROLL CALL Present: Council Members Serge, Szymkowiak Beck, Taylor,
<br />Zielinski, Dombrowski, Voorde and McGann
<br />Absent: Council Member Crone
<br />REPORT FROM THE SUB - COMMITTEE ON MINUTES
<br />To the Common Council of the City of South Bend:
<br />Your sub - committee on the inspection and supervision of the minutes would res-
<br />pectfully report that it has inspected the minutes of the January 11, and January 25,
<br />1982, meetings of the Council and found them correct.
<br />The sub - committee, therefore, recommends that the same be approved.

<br />Council Member Serge made a motion that the minutes of the January 11, and January
<br />18, 1982, meetings of the Council be accepted and placed on file, seconded by Council
<br />Member Beck. The motion carried.
<br />SPECIAL BUSINESS
<br />Council President McGann indicated that Council Member Zielinski will have a Util-
<br />ities Committee meeting on Solid Waste problems. Council Member Voorde made a motion
<br />to appoint Jack Rasmussen to the Human Resources and Economic Development Committee,
<br />seconded by Council Member Szymkowiak. The motion carried.
<br />REPORTS
<br />Council Member Zielinski indicated that the Recodificiation Committee had meet re-
<br />garding Bill No. 8 -82, and gave favorable recommendation to a substitute bill filed
<br />with the City Clerk.
<br />Council Member Dombrowski made a motion to resolve into the Committee.of the Whole,
<br />seconded by Council Member Beck. The motion carried.
<br />COMMITTEE OF THE WHOLE
<br />Be it remembered that the Common Council of the City of South Bend met in the Com-
<br />mittee of the Whole on Monday, February 8, 1982, at 7:06 p.m., with eight members
<br />present. Chairman Voorde presiding.
<br />BILL NO. 137 -81
<br />A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY
<br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,
<br />INDIANA (CHAPTER 21, MUNICIPAL CODE.) (NORTHWEST CORNER OF
<br />RIVERSIDE AND ANGELA.)
<br />Now is the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. Council President McGann made a
<br />motion to amend this bill by changing Section 2, to read as follows: This Ordinance
<br />shall be in full force and effect from and after its passage by the Common Council,
<br />approval by the Mayor, and it shall be subject to the following conditions: 1) That
<br />a written lease not to exceed twenty (20) years (excluding renewal options) be ex-
<br />ecuted by and between the City of South Bend, Indiana, as lessor, and a lessee. 2)
<br />that said lease shall become effective following its approval by the Common Council.
<br />3) That Resolution No. 17 which was adopted by the Board of Public Works on August
<br />24, 1981, and ratified by the Common Council on August 3, 1981, shall be null and
<br />void upon the happening of condition 2 above., seconded by Council Member Serge. The
<br />motion carried. Larry Magliozzi, from Area Plan, gave the staff report. Warren
<br />McGill, attorney representing the petitioner, made the presentation for the bill. He
<br />indicated the petitioner seeks to have the land rezoned to "D" Light Industrial. He
<br />indicated that the lease arrangement was acceptable to Lock Joint Tube. He indicated
<br />this was a 1.8 acres parcel of land, and they will by using only 19 %, and 81% will
<br />remain as green area. He indicated no buildings will be built on the land. He indi-
<br />cated that Lock Joint Tube proposed to have the parking lot properly landscaped.
<br />William Williams, 831 W. North Shore, indicated that the entrance to the truck depot
<br />should be on Riverside, not Angela. He presented a petition to the City Clerk signed
<br />by 381 people opposed to this rezoning. Julie Egenhoefer, 722 Marquette, a St. Joseph's
<br />High School student and Kathy Byrne, 530 Marquette, a Holy Cross student, presented
<br />Petitions signed by students and teachers against the sale of this property. Wayne
<br />Werts, 1889 Riverside, spoke against this rezoning. Thomas Swartz, 402 Marquette,
<br />indicated that a truck depot would not be in the interest of the neighborhood. Dominick
<br />DaCasta, 754 N. Cottage Grove, spoke against this rezoning. Jane Swan, 1706 S. Walnut,
<br />indicated she would rather see a lease than a sale. Irene Mutzl, 320 Parkovash,
<br />indicatd this rezoning should be dealyed in order that consideration be given to the
<br />entrance being on Riverside. James Cronk, 702 E. LaSalle; Thomas Broden, 201 W. North
<br />Shore; Terry Coleman, 2114 Portage, spoke against this rezoning. Council member
