REGULAR MEETING JANUARY 25, 1982 <br />BILL NO. 6 -82 <br />A BILL REQUESTING VACATION OF VARIOUS PUBLIC RIGHTS -OF -WAY <br />IN THE MONROE- SAMPLE DEVELOPMENT AREA IN THE CITY OF SOUTH <br />BEND, INDIANA. <br />Now is the time heretofore set for public hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. Patrick McMahon, Director of Re- <br />development, made the presentation for the bill. He indicated this was the balance <br />of the vacations of public right -of -ways in an area bounded by Bronson, Marietta, <br />Sample and Fellows Street; and Clinton Street between Bronson and Sample Street, in <br />the Monroe - Sample Development Area. Council Member Szymkowiak made a motion to re- <br />commend this bill to the Council favorable, seconded by Council Member Beck. The <br />motion carried. <br />BILL NO. 7 -82 <br />A BILL AMENDING CHAPTER 4 OF THE SOUTH BEND MUNICIPAL CODE <br />TO REQUIRE LICENSING OF PRCIOUS METALS DEALERS. <br />Now is the time heretofore set for public hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. Richard Hill, City Attorney, made <br />the presentation for the bill. He indicated this bill creates a new license, that of <br />precious metals dealer. He indicated provides that a dealer must file a report with- <br />in twenty- four.hours with the police Department, keep a record of the- seller .'s,des - <br />cription, photograph every purchase with value in- excess, -of $50, and all metals pur <br />chased must be held for seven days. Spiro Krekelas, 329 Dixie, Way North,''ridicated <br />that holding the merchandise for seven days was too long, and that taking'a photo was <br />not going to make that much difference. Steve Cloter, 1117 Mishawaka Ave., Elkhart, <br />spoke against holding the merchandise for seven days. County Prosecutor, Michael <br />Barnes, County Prosecutor, indicated he hoped the county and Mishawaka would also <br />adopt similar controls. He indicated the foscus should be on the victim of crimes. <br />He indicated part of the problem with the forty -eight hour period was over a weekend. <br />Council Member McGann indicated that perhaps a photo should be taken of the seller, <br />or a thumb print. Michael Barnes indicated that there could be legal problems if <br />that was required. Council Member McGann made a motion to amend the bill in Sec. 4- <br />44, (c)(1) be adding "and the account number of one additional piece of recognized <br />identification. ", seconded by Council Member Dombrowski. The motion carried. Coun- <br />cil Member Dombrowski made a mtoion to recommend this bill to the Council favorable, <br />as amended, seconded by Council Member Zielinski. The motion carried. <br />There being no further business to come before the Committee of the Whole, Council <br />Member Dombrowski made a motion to rise and report to the Council, seconded by Coun- <br />cil Member Beck. Council Member Dombrowski made a motion to pass this <br />bill, seconded by Council Member Beck. The bill passed by a roll call vote of seven <br />ayes. <br />ORDINANCE NO. 7020 -82 <br />AN ORDINANCE DESIGNATING AND ESTABLISHING AN HISTORIC LAND- <br />MARK UNDER ORDINANCE NO. 5565 -73, AMENDING ORDINANCE NO. <br />4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE <br />OF THE CITY OF SOUTH BEND (2119 PORTAGE AVE.) <br />This bill had second reading. Council Member Beck made a motion to pass this bill, <br />seconded by Council Member Taylor. The bill passed by a roll call vote of seven <br />ayes. <br />ORDINANCE NO., 7021 -82 AN ORDINANCE APPROPRIATING THE SUMA.,OF $46,53.4.33 FROM THE <br />,_ CUMULATIVE SEWER BUILDING.AND SINKING FUND TO THE GENERAL <br />IMPROVEMENT FUND. <br />This bill had second reading. Council Member Taylor made a motion to pass this bill, <br />seconded by Council Member Dombrowski.
