<br />AUGUST 10, 1981
<br />Be it remembered that the Common Council of the City of South Bend met in the Council
<br />Chambers of the County -City Building on Monday, August 10, 1981, at 7:00 p.m. The
<br />meeting was called to order and the Pledge to the Flag was given.
<br />ROLL CALL Present: Council Members Serge, Szymkowiak Beck, Taylor,
<br />Zielinski, Crone, Dombrowski, Voorde and McGann

<br />REPORT FROM THE SUB - COMMITTEE ON MINUTES
<br />To the Common Council of the City of South Bend:
<br />Your sub - committee on the inspection and supervision of the minutes would res-
<br />pectfully report that it has inspected the minutes of the July 27, 1981, meeting of
<br />the Council and found them correct.
<br />The sub - committee, therefore, recommends that the same be approved.

<br />Council Serge made a motion that the minutes of the July 27, 1981, meeting of the Council
<br />be accepted and placed on file, seconded by Council Member Beck. The motion carried.
<br />SPECIAL BUSINESS
<br />Council Member Dombrowski made a motion to hold the August 31, 1981, meeting of the
<br />Council at 5:00 p.m., seconded by Council Member Beck. The motion carried.
<br />Council President McGann indicated they had received a request from Historic Pre-
<br />servation Commission to grant a stay to the demolition of 609 Lincoln Way East. John
<br />Stamper, Director of Historic Preservation Commission, indicated that the Commission
<br />voted to petition the Council for a stay of demolition for the house at 609 Lincoln
<br />Way East. He indicated it was the Commission's contention that there should be more
<br />time given to study alternatives for saving this house and other houses in this block.
<br />He indicated there was a project underway across the street by Historic Landmark
<br />Foundation and Southhold Foundation to study and develop a program for preservation
<br />in the area, and the Commission would like them to study this side of the street
<br />also, and possibly they can make some recommendations. He indicated that as a result,
<br />they hope to market this house and adjacent houses either to have them restored or
<br />moved to another location where they can be restored. Council Member Crone made a
<br />motion to delay until December 10, 1981, the demolition order for the house located
<br />at 609 Lincoln Way East, however, if said structure is deemed by the code enforcement
<br />officer to deteriorate further, causing an immediate danger to public health, safety
<br />and welfare, said delay shall immediately abate and the demolition order shall be
<br />proceeded upon by the City, seconded by Council Member Taylor. The motion carried.
<br />Ruth Price, President of the Historic Preservation Commission, indicated that the
<br />Commission appreciated the Council's consideration in allowing the Commission and
<br />other agencies to come up with a preservation plan. She indicated that the in the
<br />event the houses are demolished and the land is open for development, the Commission
<br />does have the right of design review, because this property is located in an Historic
<br />District. Georginia DeLaruelle, 553 Edgewater, indicated she represented the planning
<br />commission of the Edgewater District. She presented a petition requesting delay of
<br />demolition of the house at 609 Lincolnway East, as well as the garage at 601 Lincolnway
<br />East, signed by 43 residents residing within the Edgewater District. Richard Hill,
<br />City Attorney, indicated that the Administration supported the concerns of the Historic
<br />Preservation Commission. He indicated that the Council could be setting a precedent
<br />by taking action on this matter. He indiated that the Administration would be willing
<br />to agree not to take action to demolish this structure until whatever timetable the
<br />Council would recommend. He indicated they were willing to work with members of the
<br />Historic Preservation Commission and would commit to follow the four month timetable.
<br />John Oxian, Vice President of Historic Preservation, indicated that if the Council
<br />was willing to go along with the City, he had no disagreement. Council President
<br />McGann asked members of the Historic Preservation Commission and Edgewater Historic
<br />District if they would be willing to withdraw the petition, based on the agreement
<br />with the City not to distroy the structure until December. There was no objection to
<br />withdrawing the petition. The petition was withdrawn.
<br />REPORTS
<br />Council Member Crone indicated that the Personnel & Finance Committee held budget
<br />hearings on August 5 and 6, and had no recommendations at this time.
<br />Council Member Dombrowski made a motion to resolve into the Committee of the Whole,
<br />seconded by Council Member Taylor. The motion carried.
