<br />SPECIAL BUSINESS (CONTINUED
<br />Council President McGann indicated that first reading should be given a bill regarding
<br />zoning of mobile homes in residential sections of the City.
<br />BILL NO. 11 -81 A BILL AMENDING AND SUPPLEMENTING CHAPTER 21 OF THE MUNICIPAL
<br />CODE OF THE CITY OF SOUTH BEND, INDIANA, GENERALLY KNOWN AS
<br />THE SOUTH BEND ZONING ORDINANCE, BEING ORDINANCE NO. 4990 -68,
<br />AS AMENDED.
<br />This bill had first reading. Council President McGann made a motion to refer this bill
<br />to Area Plan, seconded by Council Member Beck. The motion carried.
<br />REPORTS
<br />Council Member Taylor indicated that the Public Safety Committee had met and gave a favor-
<br />able recommendation to Bill No. 4 -81 regarding conformance with the Unsafe Building Law.
<br />Council Member Taylor made a motion to resolve into the Committee of the Whole, seconded
<br />by Council Member Dombrowski. The motion carried.

<br />Be it remembered that the Common Council of the City of South Bend met in the Committee
<br />of the Whole on Monday, January 26, 1981, at 7:10 p.m., with nine members present. Chairman]
<br />Voorde presiding.
<br />BILL NO. 2 -81 A BILL AUTHORIZING THE CITY OF SOUTH BEND TO ISSUE ITS "CITY
<br />OF SOUTH BEND ECONOMIC DEVELOPMENT REVENUE NOTE, SERIES 1981
<br />(SOUTH BEND MEDICAL FOUNDATION, INC. PROJECT)" AND APPROVING
<br />OTHER ACTIONS IN RESPECT THERETO.
<br />This being the time heretofore set for public hearing on the above bill, proponents and 3
<br />opponents were given an opportunity to be heard. Kenneth Fedder, attorney for the Economic
<br />Development Commission, made the presentation for the bill. He indicated this $2,150,000 1
<br />issue would be used to pay the costs of construction and equipping an addition to the
<br />Medical Foundation. He indicated that 20 -25 jobs will be created. Council Member Kopezynskii
<br />made a motion to recommend this bill to the Council favorable, seconded by Council Member
<br />Dombrowski. The motion carried.
<br />BILL NO. 132 -80
<br />A BILL AMENDING ORDINANCE NO.4990 -68, AS AMENDED, COMMONLY
<br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,
<br />INDIANA (CHAPTER 21, MUNICIPAL CODE) (4325 S. MAIN.)
<br />This being the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. Council President McGann made a motion
<br />to accept a substitute bill filed in the City Clerk's office, seconded by Council Member
<br />Taylor. The motion carried. Oscar Van Wiele, a realtor with Century 21, made the pre-
<br />sentation for the bill. He described the property and indicated the propective purchaser
<br />planned to use the existing 32 x 40 garage as an automobile repair shop. He described the
<br />surrounding area, which he indicated was basically commercial. Council Member Kopczynski
<br />made a motion to recommend this bill to the Council favorable, as amended, seconded by
<br />Council Member Szymkowiak. The motion carried.
<br />BILL NO. 136 -80 A BILL AMENDING CHAPTER 21, SECTION 21 -88 OF THE MUNICIPAL
<br />CODE OF SOUTH BEND, OFF - STREET PARKING AND LOADING FACILITIES,
<br />CHANGE IN USE.
<br />This being the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. Richard Hill, City Attorney, indicated
<br />this bill was to clearly establish the responsibility of an owner or developer to provide
<br />sufficient parking to meet the needs of his facility. He indicated that any change in
<br />use of an existing structure will have to meet the same parking requirements as would a
<br />developer of a new building. Council Member Szymkowiak made a motion to recommend this
<br />bill to the Council favorable, seconded by Council Member Serge. The motion carried.
<br />BILL NO. 4 -81 A BILL AMENDING CHAPTER VI OF THE MUNICIPAL CODE OF SOUTH BEND
<br />TO BRING THE CODE INTO CONFIRMANCE WITH THE UNSAFE BUIDLING
<br />LAW OF THE STATE OF INDIANA, INDIANA CODE 18- 5 -5.5 -4 (5) (b)
<br />AND REPEALING CHAPTER 11, ARTICLE 4, OF THE MUNICIPAL CODE,
<br />This being the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. Kathy Barnard, Director of Neighborhood
<br />Code Enforcement, made the presentation for the bill. She.:ifid cated that presently a
<br />structure is not considered vacant until it has been unoccupied and open for 30 days, and
<br />then the property owner is notified and has 15 days to board the building. She indicated
<br />that a recent. amendment to the Unsafe Building law allows that a vacant structure can be
<br />boarded after the property owner has been notified and given 10 days to secure the structure,'
<br />Manuel Garcia, representing the Northwest Neighborhood Association, commended Kathy Barnard;:
<br />for this bill. Council Member Taylor made a motion to recommend this bill to the Council
<br />favorable, seconded by Council Member Dombrowski. The motion carried.
