54. <br />REGULAR MEETING OCTOBER 27, 1980 <br />REGULAR.MEETING_RECONVENED <br />Be it remembered that the Common Council of the City of South Bend reconvened in the <br />Council Chambers on the fourth floor of the County -City Building at 7:17 p.m. Council <br />President McGann presiding and nine members present. <br />BILLS. SECOND READING <br />ORDINANCE NO. 6857 -80 <br />AN ORDINANCE APPROVING THE FORM AND TERMS OF TRUST <br />INDENTURE AND USER AGREEMENT, REAL ESTATE MORTGAGE <br />AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND <br />AUTHORIZING THE EXECUTION THEREOF, AND APPROVING <br />RESOLUTION NO. 27 -80 OF THE SOUTH BEND ECONOMIC <br />DEVELOPMENT COMMISSION RELATING TO THE NILES <br />AVENUE PARNERSHIP PROJECT. <br />This bill had second reading. Council Member Serge made a motion to pass this bill, <br />seconded by Council Member Szymkowiak. The bill passed by a roll call vote of nine ayes. <br />ORDINANCE NO. 6858 -80 <br />AN ORDINANCE APPROPRIATING $15,000.00 FROM THE COM- <br />MUNITY DEVELOPMENT BLOCK GRANT FUND FOR THE SUPPORT <br />OF SPECIALIZED TRANSPORTATION SERVICES TO BE AD- <br />MINISTERED BY BY THE CITY OF SOUTH BEND THROUGH <br />ITS DIVISION OF COMMUNITY DEVELOPMENT AND <br />SPECIALIZED TRANSPORTATION SYSTEM OF ST. JOSEPH <br />COUNTY. <br />This bill had second reading. Council Member Szymkowiak made a motion to pass this <br />bill, seconded by Council Member Dombrowski. The bill passed by a roll call vote of <br />nine ayes. <br />ORDINANCE NO. 6859 -80 <br />AN ORDINANCE APPROPRIATING $9,500.00 FROM THE COM- <br />MUNITY DEVELOPMENT BLOCK GRANT FUND FOR THE SUPPORT <br />OF AN OLDER ADULTS CRIME VICTIM PROGRAM ACTIVITY TO <br />BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS <br />DIVISION OF COMMUNITY DEVELOPMENT AND THE REAL SERVICES <br />AGENCY. <br />This bill had second reading. Council Member Szymkowiak made a motion to pass this <br />bill, seconded by Council Member Beck. The bill passed by a roll call vote of nine ayes. <br />RESOLUTIONS <br />RESOLUTION NO. 832 -80 <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY <br />OF SOUTH BEND, COMMONLY KNOWN AS_2222 W. WASHINGTON, <br />TO BE AN URBAN DEVELOPMENT AREA FOR PURPOSES OF REAL <br />PROPERTY TAX ABATEMENT AND A DETERMINATION OF THE <br />PUBLIC UTILITY AND BENEFIT OF THE PROJECT PROPOSED <br />FOR TAX ABATEMENT CONSIDERATION. <br />WHEREAS, the Common Council of the City of South Bend has adopted a Declaratory <br />Resolution designating certain areas within the City as Urban Development Areas for <br />purposes of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designating the area commonly known as Merry <br />Avenue Project and more particularly described by a line drawn as follows: <br />A parcel of land in the Northeast Quarter of Section 10, Township 37 North, Range 2 East, <br />Known as Arnold's First Addition (lots 1 -44), vacated alleys and streets) to the City <br />of South Bend, St. Joseph County, Indiana more particularly described as follows: <br />Beginning at the intersection of the West right -of -way line of Grant Street and the <br />South line of West Washington Avenue; thence S 0 degrees 03' 08" W a distance of 514.92 <br />feet to the intersection of the North right -of -way line of the Penn Central Railroad; <br />thence N 64 degrees 39.1. 26" W on and along the North right -of -way line of said railroad <br />a distance of 1194.77 feet to the intersection of the North right -of -way line of said <br />railroad and the East right -of -way line of Olive Street; thence No 82 degrees 43' 43" E <br />a distance of 74.33 feet to a point on the South right -of -way line of Washington Avenue <br />West; thence S 89 degrees 39' 53" E on and along the South right -of -way of said avenue <br />a distance of 1006.55 feet to the place of beginning containing (283,072 sq. fet.) 6.50 <br />acres more or less subject to all legal easements. <br />EXCEPTING: <br />A parcel of land beginning at a point located on the Southeast_ corner of Lot No. 44 in <br />Arnold's First Addition to the City of South Bend; thence North 514', more or less, to <br />the Northeast corner of Lot No. l in said Addition; thence West 200', more or less, to <br />the Northwest corner of Lot No. 5 in said addition; then South 4241, more or less, to <br />the Northwest corner of Lot No. 43 in said Addition; then Southeast a distance of 204.7', <br />more or less, to the place of beginning. <br />is an Urban Development Area; and <br />WHEREAS, the Area Plan Commission has submitted to the Council its written order <br />approving for the Declaratory Resolution to the Council; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council have been published pursuant to Indiana Code 18- 7 -7 -14; and <br />
