ORDINANCE NO. 1p y q c� °ii <br />AN ORDINANCE AMENDING CHAPTER 20, ARTICLE <br />3, COMMONLY KNOWN AS THE ABANDONED VEHICLE <br />ORDINANCE, <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council of the City of South Bend recognizes that <br />abandoned vehicles present a scenic blight and are a public nuisance. <br />The purpose and intent of this amendment is to provide for a even <br />more efficient procedure for the removal and disposal of abandoned <br />vehicles; and to allow the Board of Public Safety to establish towing <br />and storage fees. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City <br />of South Bend, Indiana, as follows: <br />SECTION I. Chapter 20, Article 3 of the Municipal Code of the <br />City of South Bend, Indiana, is hereby amended as follows: <br />ARTICLE 3. ABANDONED VEHICLES. <br />Sec. 20 -28. Definitions. <br />(g) "Visible from public property" I as used in this Article shall <br />mean that even if a covering which has been placed over the vehicle and <br />ww c is of a temporary, non - structural nature including but not limit <br />to, a tarpaulin or other similar material whereby the form and outline <br />of the vehicle remains visible to the public; said vehicle shall be <br />deemed visible from public property. <br />Sec. 20 -29. Procedure for Notice, Removal and Disposition of <br />Abandoned Vehicles, Fees. <br />(f) Fees. Said fee shall be determined <br />and fixed by the Board of Public Safety. The Board shall have authority <br />to periodically review said fees and to establish fees which are rea- <br />sonably necessary for towing and storage services within the City. <br />SECTION II.
