ORDINANCE NO. 9tK--2 9 <br />AN ORDINANCE AMENDING VARIOUS SECTIONS WITHIN CHAP- <br />TER 20, ARTICLE 7, SNOW ROUTES, AND CHAPTER 20, <br />ARTICLE 1, GENERAL PROVISIONS, ADMINISTRATION AND <br />REGULATIONS OF THE MUNICIPAL CODE OF THE CITY OF <br />SOUTH BEND, INDIANA. <br />STATEMENT OF PURPOSE AND INTENT: <br />In that efficient snow removal procedures are essential to the health, <br />safety and economic benefit of this community; and <br />In that residential areas can best be cleared of snow during normal <br />working hours; and <br />In that it is desirable that all of the City's streets remain function- <br />ing during the snow season, <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br />SOUTH BEND, INDIANA, as follows: <br />SECTION I: Chapter 20, Article 7, Snow Routes, of the Municipal Code <br />of the City of South Bend, Indiana, is hereby amended to read in its entirety <br />as follows: <br />Section 20 -101: Definitions <br />As used in this article: <br />1) Snow Removal Condition means a formal declaration by the Snow <br />Removal Coordinator that in his opinion the actual or expected <br />precipitation of snow will create hazardous or dangerous street <br />and sidewalk conditions. This declaration shall take one of the <br />following forms: <br />Snow Emergency <br />Residential Emergency <br />Weather Disaster <br />2) Snow Emergency means a snow removal condition which addresses all <br />designated snow routes (main routes). <br />3) Residential Emer enc means a snow removal condition which addresses <br />all non -snow routes residential streets). <br />4) Weather Disaster means a formal declaration by the Snow Removal <br />Coordinator that occurrence or eminent threat of widespread or <br />severe damage, injury or loss of life or property resulting from <br />a snow storm requires emergency action to avert danger, damage <br />or distress.
