REGULAR MEETING DECEMBER 16, 1985 <br />ORDINANCE NO. 7.567 -85 AN ORDINANCE AUTHORIZING THE ISSUANCE AND SALE OF <br />$20,000,000.00 ECONOMIC DEVELOPMENT REVENUE BONDS OF <br />THE CITY OF SOUTH BEND, INDIANA, FOR THE PURPOSE OF <br />MAKING A LOAN TO FINANCE THE ACQUISITION, AND <br />CONSTRUCTION OF CERTAIN ECONOMIC DEVELOPMENT FACILITIES <br />LOCATED IN THE CITY PERTAINING TO MILL RACE, AN INDIANA <br />LIMITED PARTNERSHIP; AUTHORIZING THE EXECUTION OF A <br />LOAN AGREEMENT; PROVIDING FOR THE DELIVERY OF A NOTE <br />AND ASSIGNMENT THEREOF AS SECURITY FOR SAID BOND; <br />AUTHORIZING AN INDENTURE OF TRUST APPROPRIATE FOR THE <br />PROTECTION AND DISPOSITION OF THE REVENUES FROM SUCH <br />NOTE; AND AUTHORIZING THE TERMS AND SALE OF SAID BOND. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Kenneth Fedder, attorney for <br />the Economic Development Commission, made the presentation for the bill. He <br />indicated Mill Race intended to build a seventeen story complex with 208 rental <br />units. He indicated the in addition to the construction jobs involved over the next <br />several years, approximately 84 new jobs will be created. Council Member Taylor <br />made a motion to pass this bill, seconded by Council Member Zakrzewski. The bill <br />passed by a roll call vote of nine ayes. <br />Council Member Taylor indicated that a straw vote had been taken and the new <br />officers for 1986 would be Beverlie Beck as president, Eugenia Braboy, vice <br />president and Ann Puzzello, chairman of the Committee of the Whole. Council <br />President Beck announced that election of officers will be held January 6, at noon. <br />REPORTS <br />Council Member Voorde indicated that the Zoning and Vacation Committee had met on <br />bill nos. 121, 132 and 170 -85 and had no recommendation, due to the petitioners not <br />being present. <br />Council Member Puzzello indicated the the Personnel & Finance Committee had met on <br />Bill No. 171 -85 and gave no recommendation. <br />Council Member Braboy indicated that the Human Resources Committee had met on bill <br />nos. 168 and 173 -85 and recommended them favorable. <br />BILL NO. 121 -85 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT <br />1409 -1411 LINDEN AVE., IN THE CITY OF SOUTH BEND, INDIANA. <br />Council Member Voorde made a motion to continue public hearing on this bill until <br />January 13, seconded by Council Member Taylor. The motion carried. <br />BILL NO. 132 -85 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE 1ST <br />NORTH -SOUTH ALLEY WEST OF LAUREL STREET RUNNING FROM WESTERN <br />AVENUE TO NAPIER STREET, EXCEPTING THE INTERSECTING EAST -WEST 14' <br />ALLEY FOR A DISTANCE OF 243.56 FEET MORE OR LESS, ALL BEING ON <br />WILLETS SUBDIVISION OF B.O.L. 89 AND DEARDOFFS SUBDIVISION OF <br />B.O.L. 90 AND LYING BETWEEN LOTS 1 AND 10 OF LOTS 6 AND 15 <br />RESPECTIVELY. <br />Council Member Voorde made a motion to continue public hearing on this bill until <br />January 13, seconded by Council Member Taylor. The motion carried. <br />BILL NO. 170 -85 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: 1ST EAST -WEST <br />ALLEY SOUTH OF DELAWARE STREET RUNNING EAST FROM OLIVE STREET TO <br />PHILLIPA LYING BETWEEN LOTS 259 THRU 264 AND LOTS 277 THRU 282 <br />ALL BEING IN "HIGHLAND PARK 2ND ADD" AND "HIGHLAND PARK 2ND ADD" <br />(UNRECORDED) TO THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, <br />INDIANA. <br />Council Member Voorde made a motion to continue public hearing on this bill until <br />January 13, seconded by Council Member Crone. The motion carried. <br />BILL NO. 127 -85 <br />A BILL AMENDING CHAPTER TWO, ARTICLE XIII OF THE SOUTH BEND <br />MUNICIPAL CODE BY ADDING AN ADDITIONAL ECONOMIC DEVELOPMENT <br />TARGET AREA THERETO COMMONLY KNOWN AS ELM STREET BETWEEN COLFAX <br />AND WESTERN AND OLIVE STREET BETWEEN WESTERN AND WASHINGTON. <br />Council Member Braboy made a motion to continue this bill indefinitely, seconded by <br />Council Member Puzzello. The motion carried. <br />Council Member Puzzello made a motion to combine public hearing on bill nos. 136, <br />139, 160, 163, 164, 165, 166 and 167 -85, seconded by Council Member Beck. The <br />motion carried. <br />Council Member Voorde made a motion to accept substitute bills 139, 163, 164 and <br />165 -85, on file with the City Clerk, seconded by Council Member Zakrzewski. The <br />motion carried. <br />
