<br />BILL NO. 26 -85 A BILL DESIGNATING AND ESTABLISHING AN HISTORIC LANDMARK UNDER
<br />ORDINANCE NO. 5565 -68, AMENDING ORDINANCE NO. 4990 -68, AS AMENDED,
<br />COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND.

<br />This being the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. John Oxian, Vice President of Historic
<br />Preservation, made the presentation for the bill. He indicated his home ranted as an
<br />11. He indicated he home was built in 1855. Council Member Taylor made a motion to
<br />recommend this bill to the Council favorable, seconded by Council Member Beck. The
<br />motion carried.
<br />BILL NO. 28 -85 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST ALLEY
<br />EAST OF FRANCIS STREET RUNNING NORTH FROM CORBY STREET FOR A DISTANCE
<br />OF 205 FEET TO THE SOUTH LINE OF THE VACATION RESOLUTION NO. 2998 (ALL
<br />BEING SORIN'S SECOND ADDITION TO THE TOWN OF LOWELL, NOW WITHIN AND A
<br />PART OF THE CITY OF SOUTH BEND, INDIANA). SAID ALLEY IS IN THE BLOCK
<br />E BOUNDED BY FRANCIS STREET, HOWARD STREET, EDDY STREET AND CORBY
<br />STREET.
<br />This being the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. Fred Boynton, attorney, made the
<br />presentation for the bill. He indicated this alley was located between Goodwill and a
<br />car wash. He indicated a portion of this alley was already vacated. Council Member
<br />Puzzello made a motion to recommend this bill to the Council favorable, seconded by
<br />Council Member Zakrzewski. The motion carried.
<br />BILL NO. 10 -85 A BILL OF THE CITY OF SOUTH BEND, INDIANA, ESTABLISHING DEFERRED
<br />COMPENSATION PLAN (S).
<br />This being the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. Council Member Puzzello made the
<br />presentation for the bill. Council Member Beck made a motion to accept the amended
<br />version of the bill on file with the City Clerk, seconded by Council Member Zakrzewski.
<br />The motion carried. Council Member Puzzello indicated that this deferred compensation
<br />plan was a way to save money and a tax reduction plan for City employees. Council Member
<br />Zakrzewski made a motion to recommend this bill, as amended, to the Council favorable,
<br />seconded by Council Member Braboy. The motion carried.
<br />BILL NO. 27 -85 A BILL AMENDING CHAPTER 2, ARTICLE 6, OF THE SOUTH BEND MUNICIPAL
<br />CODE, ENTITLED TAX ABATEMENT PROCEDURES.
<br />This being the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. Council Member Beck made a motion to
<br />accept the substitute bill on file with the City Clerk, seconded Council Member
<br />Zakrzewski. The motion carried. Kathy Cekanski- Farrand, Council Attorney, made the
<br />presentation for the bill. She indicated this bill would correct the legal description
<br />for the tax abatement areas, as well as make two minor amendments. She indicated the
<br />first amendment would be that the 100 new permanent jobs be created within 18 months of
<br />the adoption of the confirming resolution; the second would place a six month waiting
<br />period in effect for petitioners who were denied tax abatement and wish to repetition.
<br />Council Member Voorde made a motion to recommend this bill, as amended to the Council
<br />favorable, seconded by Council Member Zakrzewski. The motion carried.
<br />BILL NO. 33 -85 A BILL APPROPRIATING $81,000.00 FROM THE LOCAL ROAD AND STREET FUND TO
<br />PROJECT R &S 8506, SR 23 AND OLIVE STREET WIDENING AND SIGNALIZATION.
<br />This being the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. John Leszczynski, City Engineer, made
<br />the presentation for the bill. He indicated this appropriation would be used for
<br />widening and signalization for State Road 23 and Olive Road. Marty Steinhofer, 725
<br />Fairway, Hildy Zemlyak, 1903 Franklin, Susan Hamilton, 3429 Locust Rd., Gene Minnick,
<br />1922 Kemble, spoke in favor of this appropriation. Council Member Zakrzewski made a
<br />motion to recommend this bill to the Council favorable, seconded by Council Member
<br />Voorde. The motion carried.
<br />BILL NO. 34 -85 A BILL APPROPRIATING $20,00.00 FROM THE LOCAL ROAD AND STREET FUND TO
<br />PROJECT R &S 8505 ISLAND REMOVAL ON SAMPLE WEST OF CHAPIN WITHIN THE
<br />LOCAL ROAD AND STREET FUND.
<br />This being the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. John Leszczynski, City Engineer, made
<br />the presentation for the bill. He indicated this appropriation would be used for removal
<br />of the island on Sample, west of Chapin. Council Member Zakrzewski made a motion to
<br />recommend this bill to the Council favorable, seconded by Council Member Paszek. The
<br />motion carried.
<br />BILL NO. 35 -85 A BILL APPROPRIATING $21,000.00 FROM THE CUMULATIVE SEWER BUILDING AND
<br />SINKING FUND TO PROJECT CS 829 RIVERSIDE DRIVE SEWER, WITHIN THE
<br />CUMULATIVE SEWER BUILDING AND SINKING FUND.
