<br />EXCEPTING THEREFROM the following described exception parcels:
<br />Exception Parcel 1:
<br />Beginning in the Southwesterly line of Portage Avenue in said City of South
<br />Bend, at a point South 37 degrees 48 minutes East 297.0 feet from the intersection
<br />of the South line of Elwood Avenue with the Southwesterly line of said Portage
<br />Avenue, as this intersection existed prior to October 17, 1975; running thence
<br />South 37 degrees 48 minutes East along said Southwesterly line of said Portage
<br />Avenue, 152.0 feet to a point 40.5 feet, more or less, measured at right angles
<br />from the Northwesterly right -of -way line of the Chicago, Indiana Southern Railroad;
<br />thence South 37 degrees 20 minutes west 103.6 feet on the long chord of a curve
<br />to the left, which curve is parallel to and at all points 40.5 feet, mor or
<br />less, distant from the said northwesterly right -of -way line of said Chicago,
<br />Indiana Southern railroad; thence North 37 degrees 48 minutes West 178.65 feet;
<br />thence North 52 degrees 12 Minutes East 100 feet to the point of beginning.
<br />Exception Parcel 2:
<br />Beginning at the intersection of the Westerly line of Portage Avenue and the
<br />South line of Elwood Avenue in the City of South Bend, as this intersection
<br />existed prir to October 17, 1975, thence Southeasterly along the Westerly line
<br />of Portage Avenue, One Hundred Twelve (112) feet, thence angle Southwesterly
<br />Ninety (90) degrees a distance of One Hundred Twenty -eight (128) feet; tence
<br />Northerly parallel to Portage Avenue line a distance of sixty -one (61) feet;
<br />thence Northeasterly approximately One Hundred Nineteen (119) feet to a point
<br />in the South line of Elwood Avenue as it existed prior to October 17, 1975,
<br />Seventy and Four Tenths (70.4) feet West of the place of beginning; thence East
<br />along the South line of Elwood Avenue, as it existed prior to October 17, 1975,
<br />Seventy and Four Tenths (70.4) feet to the point of beginning.
<br />Together with a perpetual easement of passage over and across n adjoining parcel
<br />bounded by a line running as follows:
<br />Beginning at a point in the South line of Elwood Avenue, as it existed prior to
<br />October 27, 1975, One Hundred and Four Tenths (100.4) feet west of the intersection
<br />of said South line with the Westerly line of Portage Avenue; as this intersection
<br />existed prior to October 17, 1975, thence East along said South line, as it
<br />existed prior to October 17, 1975, Thirty (30) feet; thence South Thirty -nine
<br />and Fifty -seven Hundredths (39.57) feet; thence Northwesterly Forty -six (46)
<br />feet, mor or less, to the point of beginning, except that part the of conveyed
<br />to the City of South Bend by Record 807, page 562 and assigned to said City by
<br />Assignment of Easement etc. in Deed Record 807, pages 559 et eq.
<br />Exception Parcel 3:
<br />A lot or parcel of land in the Northwest Quarter of Section 2, Township 37 North,
<br />Range 2 East, in St. Joseph County, Indiana, bounded by a line running as follows,
<br />viz:
<br />Beginning at the South line of Elwood Avenue, as it existed prior to October 17,
<br />1975, 70.4 feet West of the intersection of the South line of Elwood Avenue and the
<br />Southwesterly line of Portage Avenue, as it existed prior to October 17,-1975, thence
<br />South 14.5 feet; thence West parallel to the South line of Elwood Avenue, as it
<br />existed prior to October 17, 1975, 29.5 feet thence Northwesterly 81.95 feet to a
<br />point on the South line of Elwood Avenue, as it existed prior to October 17, 1975,
<br />110.1 feet West of the place of beginning; thence East along said South line of
<br />Elwood Avenue, as it existed prior to October 17, 1975, 110.1 feet to the place of
<br />beginning, which exception is contained in a deed to Civil City of South Bend for
<br />widening of Elwood Avenue recorded in Deed Record 807, page 562.
<br />be designated as an Economic Revitalization Area under the provisions of Indiana
<br />Code 6 -1.1- 12.1 -2, et seq.; and
<br />WHEREAS, the Redevelopment Commission has concluded an investigation and prepared
<br />a report with information sufficient for the Common Council to determine that the
<br />area qualifies as an Economic Revitalization Area under Indiana Code 6- 1.1- 12.1 -1,
<br />et seq., and has further prepared maps and plats showing the boundaries and such
<br />other information as required by law of the area in question; and
<br />WHEREAS, the Human Resources and Economic Development Committee of the Common
<br />Council has reviewed said report and recommended to the Common Council that the area
<br />qualifies as an Economic Revitalization Area.
<br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
<br />Indiana, as follows:
<br />SECTION I. That the Common Council hereby accepts the report and recommendation
<br />of the Human Resources and Economic Development Revitalization Area and hereby adopts
<br />a resolution designating this area as an Economic Revitalization Area for purposes
<br />of real property tax-abatement.
