<br />WHEREAS, the Common Council of the City of South Bend has adopted a Declaratory 
<br />Resolution designating certain areas within the City as Economic Revitalization.. 
<br />Areas for the purpose of tax abatement consideration; and 
<br />WHEREAS, a Declaratory Resolution designated the area commonly known as 227 
<br />South Main Street and more particularly described by a line drawn as follows: 
<br />Forty -four feet in width North and South taken off and from the entire length 
<br />of the South side of Lot Numbered Two Hundred Sixty three (263) as shown on the 
<br />Original Plat of the Town, now City, of South Bend. and, Situate in St.. Joseph 
<br />County, in the State of Indiana: Thirty -three (33) feet taken off of and from 
<br />the entire length of the South side of Lot Numbered Two Hundred Sixty -two (262) 
<br />and Twenty -two (22) feet taken off of and from the entire length -of the North . 
<br />side of Lot Numbered Two Hundred Sixty -three (263) of the Original Plat.of.the 
<br />Town, now City of South Bend. 
<br />as an Economic Revitalization Area; and 
<br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public 
<br />hearing before the Council has been published pursuant to Indiana Code 6-1.1- 12.1 -2- 
<br />5; and 
<br />WHEREAS, the Council held a public hearing for -the purposes of hearing all 
<br />remonstrances and objections from interested persons; and 
<br />WHEREAS, the Council has determined that the qualifications for an economic 
<br />revitalization area have been met. 
<br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, 
<br />Indiana, as follows: 
<br />SECTION I. That the Common Council hereby confirms its Declaratory Resolution 
<br />designating the area described herein as an Economic Revitalization Area for the 
<br />purposes of tax abatement. Such designation is for real property tax abatement only 
<br />and is limited to five (5) calendar years from `the date of adoption of a Declaratory 
<br />Resolution by the Common Council. 
<br />SECTION II. This Resoluton shall be in full force and effect from and after 
<br />its adoption by the Common Council and approval by the Mayor.

<br />A public hearing was held on the resolution at this time. Tom Gibson, of the Holladay 
<br />Corporation, indicated this structure had been vacant and for sale for a number of 
<br />years. He indicated that the property is not located in a redevelopment area, however, 
<br />it is located directly across the street and less than one block from the central 
<br />downtown urban renewal area. He indicated that tax abatement, if granted, will have 
<br />a positive effect on the neighborhood He indicated this proposed development will 
<br />create 32 new jobs. Council Member Taylor made a motion to adopt this resolution, 
<br />seconded by Council Member Serge. The resolution was adopted by a roll call vote of 
<br />six ayes and three nays (Council Members Zakrzewski, Crone `and Voorde.) 
<br />RESOLUTION NO. 1141 -84 
<br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH 
<br />BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY 
<br />KNOWN AS THE SOUTH -WEST CORNER OF ELWOOD AVENUE AND PORTAGE 
<br />AVENUE, AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF 
<br />REAL PROPERTY TAX ABATEMENT. 
<br />WHEREAS, a petition for real property tax abatement consideration has been 
<br />filed with the Common Council of the City of South Bend requesting that the area 
<br />commonly known as the Southwest corner of Elwood Avenue and Portage Avenue, South 
<br />Bend, Indiana, and which is more particularly described by a line drawn as follows: 
<br />A tract or parcel of land in the Northwest quarter of Section 2, Township 37 
<br />North, Range 2 East, Portage Township, St. Joseph County, South Bend, Indiana, 
<br />to wit: 
<br />A tract or parcel of land in the Northwest quarter (1/4) of Section 2, Township 
<br />37 North, Range 2 East, described as beginning at a point on the South line of 
<br />Elwood Avenue, which point is Twenty (20) feet South and Nine Hundred Seventy - 
<br />five (975) feet East of the Northwest corner of the Northwest Quarter (1 /4) of 
<br />Section 2, Township 37 North, Range 2 East; running thence South One Thousand 
<br />One Hundred Eighty -four and Seventeen Hundredths (1184.17) feet more or less to 
<br />the Northerly line of the Chicago, Indiana Southern Railroad Company's right - 
<br />of -way; thence Northeasterly along said Northerly line of said Chicago, Indiana 
<br />Southern Rilroad Company's right -of -way One Thousand Sixty -three and Seven 
<br />Tenths (1063.7) feet to the Southwesterly line of Portage Avenue thence Northwesterly 
<br />along said Southwesterly line of Portage Avenue Three Hundred Eighty -nine and 
<br />Five Tenths (389.5) feet to the South line of Elwood Avenue at this intersection 
<br />existed prior to October 17, 1975, thence West along the South line of Elwood 
<br />Avenue as it existed prior to October 17, 1975, Three Hundred Sixty -three and 
<br />Four Tenths (363.4) feet to the point of beginning.
