Substitute Bill No. 09 -13 Chronic Problem Property Regulations Cover Letter <br />June 6, 2013 <br />Page 2 <br />have a ninety (90) day window and a threshold of twelve (12) verified complaints, ordinance citations <br />and /or letters; whereas other locations would have a sixty (60) day window and a threshold. of five (5) — <br />with all property owners receiving a warning notice letter from the South Bend Police Department when <br />they reached three (3) verified complaints, ordinance citations and /or letters along with a copy of this <br />ordinance and /or a reference to the website where the ordinance may be viewed <br />• Streamlines and clearly identifies the roles and responsibilities of the Police, <br />Code and Law Departments <br />• Includes a limited appeals process through a hearing officer where a owner may <br />question the "verification of whether said owner has reached the requisite and <br />applicable number" set forth above <br />Includes proactive measures through remediation agreements which would be <br />entered into between the police department and the property owner of a property <br />designated as a chronic problem property which would identify monthly <br />thresholds and needed corrective actions which police would monitor including <br />but not limited to recommendations and timetables for policy reforms, additional <br />staff, additional training, etc. <br />• Includes a process to report alleged intimidation or threats consistent with <br />governing state law <br />We are also attaching a copy of a 1 -page chart which depicts the problems associated with repeat <br />chronic problem properties; the planning cycle utilized to address them and the goals of the <br />proposed regulations; as well as a sample of an "Action Plan" for remediation agreements, and <br />the current federal HUD regulations on "tenancy addendum for Section 8 Tenant -Based <br />Assistance Housing Choice Voucher Program" which are required to be attached to tenant leases. <br />We believe this has been a very thorough and collaborative effort which has resulted in <br />regulations which are fair, reasonable, and enforceable.
