ORDINANCE NO. 6663 -79 <br />AN ORDINANCE AMENDING CHAPTER 20 OF THE <br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, <br />INDIANA, BY ADDING A NEW ARTICLE 10 <br />AUTHORIZING THE BOARD OF PUBLIC WORKS TO <br />ESTABLISH RESIDENTIAL PARKING ZONES <br />STATE OF PURPOSE AND INTENT <br />The Common Council recognizes that in certain residential areas <br />which are located near industrial, commercial, educational or public <br />service facilities there may be a traffic congestion problem caused <br />by the parking of vehicles on certain public streets in those resi- <br />dential areas by non - resident persons whose destination is one of the <br />facilities described above. <br />The Common Council further recognizes that this problem causes <br />hazardous traffic conditions to exist in those residential areas; <br />results in polluted air, excessive noise, and trash and refuse caused <br />by the entry of commuter vehicles; places an unreasonable burden upon <br />residents of those areas in gaining access to their residences; and <br />decreases the value of the property in those areas. <br />The Common Council, therefore, authorizes the Board of Public <br />Works to designate certain residential areas as Residential Parking <br />Zones in an effort to (1) reduce hazardous traffic conditions in those <br />residential areas, (2) protect those areas from polluted air, exces- <br />sive noise, and trash and refuse caused by the entry of commuter <br />vehicles, (3) protect the residents of those areas from unreasonable <br />burdens in gaining access to their residences, and (4) preserve the <br />character of those areas as residential areas and preserve the value <br />of the property in those areas. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City <br />of South Bend, Indiana, as follows: <br />SECTION I. Chapter 20 of the Municipal Code of the City of South <br />Bend, Indiana, is amended by adding a new Article 10, Section 20 -114, <br />as follows: <br />Sec. 20 -114 Application Process; Parking Study Authorized <br />(a) The lawful residents of a residential area within <br />the City may request the Board of Public Works to re- <br />strict parking on the public streets within the resi- <br />dential area to residents only by the establishment <br />of a Residential Parking Zone The request shall be <br />in the form of a petition signed by two - thirds (2/3) <br />of the lawful residents of the residential area settin <br />forth the boundaries of the residential area to be in- <br />cluded in the Residential Parking Zone and an ex lanati <br />of the need for the parking restriction. <br />(b) Upon receipt of the petition, the Board of Public <br />Works shall authorize a parking study of the residential <br />area to be conducted by the Bureau of Traffic and Lighting. <br />In conducting the study, the Bureau of Traffic and Lighting <br />shall consider the following factors in determining whether <br />a parking restriction for the residential area is warranted: <br />(1) The proximity of the residential area to <br />Industrial, commercial, educational or public _ <br />service facilities and the off - street parking <br />spaces available for persons uti izin�z such <br />acilits <br />(2) The number of vehicles operated by persons <br />whose destination is a facility described in <br />subsection 1 above which are parked on the <br />public streets within the residential area under <br />consideration—, <br />
