(3) The total number of parking spaces available <br />on the public streets within the residential area <br />under consideration. <br />(4) Any days of the week or times of day in which <br />parking on the public streets within the residential <br />area under consideration particularly may be congested. <br />(c) The Bureau of Traffic and Lighting shall not recommend <br />that a parking restriction is warranted unless the average <br />number of vehicles operated by persons whose destination is <br />a facility described in subsection (b), (1) above is in ex- <br />cess of twenty -five percent (25 %) of the total number of <br />parking spaces available on-the public streets within the <br />residential area, and the total number of parking spaces <br />on the public streets occupied by motor vehicles exceeds <br />seventy -five percent (75 %) of the total number of parking <br />spaces on the public streets in the residential area under <br />consideration. The recommendation may be limited to a <br />restriction on parking only for specific days of the week <br />or specific times of day, and may recommend that the park- <br />ing restriction be designated only for certain public <br />streets within the residential area under consideration. <br />SECTION II. Chapter 20 of the Municipal Code of the City of South <br />Bend, Indiana, is amended by adding a new Article 10, Section 20 -115, <br />as follows: <br />See. 20 -115. <br />Designation of Residential Parking Zones <br />a) Upon Recommendation of the Bureau of Traffic and <br />Lighting, the Board of Public Works may designate the <br />residential area under consideration as a Residential <br />Parking Zone. The designation shall set forth the <br />boundaries of the residential area and the parking res- <br />trictions shall be applicable only to the public streets <br />of the residential area so designated. The designation <br />shall set forth any limitations as to the days of the week <br />or times of the day in which such restriction shall be in <br />force. A copy of the designation shall be kept on file with <br />the Clerk of the Board of Public Works. <br />fib) Parking on the public streets within the residential <br />area designated as a Residential Parking Zone shall be <br />restricted to vehicles displaying a Residential Parking <br />Decal issued by the Board of Public Works. Any lawful <br />residents of the residential area so designated shall be <br />SECTION III. Penalty <br />When signs are erected giving notice, any motor vehicle <br />parked in a Residential Parking Zone in violation of the <br />restrictions for parking in the Zone and which does not <br />display a Residential Parking Decal may be ticketed and/ <br />or towed at the owner's expense in accordance with this <br />Code. <br />-2- <br />
