responding to the accident or to obtain necessary emergency medical care. (See Section 3, Delayed <br />test, Failure -to -test) <br />i. As soon as practicable following an occurrence involving a CMV operating <br />on a public road in commerce, each surviving driver must be tested for <br />alcohol and controlled substances as follows: <br />(1) If the accident involved the loss of human life; each surviving driver <br />who was performing safety -sensitive functions (see def.- 49 CFR <br />382.107) must be tested regardless of whether or not the driver <br />received a citation. Otherwise, <br />(2) If the driver received a citation under State or local law for a moving <br />traffic violation arising from the accident AND <br />(a) the accident involved bodily injury to any person who, as aresult <br />of the injury, immediately receives medical treatment away from <br />the scene of the accident; OR <br />(b) one or more motor vehicles incurred disabling damage as a result <br />of the accident, requiring the motor vehicle to be transported away <br />from the scene by a tow truck or other motor vehicle. <br />ii Exception. DOT post -accident testing requirements do not apply to <br />an occurence: <br />(1) involving only boarding or alighting from a stationary motor vehicle; or <br />(2) only the loading or unloading of cargo; or <br />(3) in the course of the operation of a passenger car or multipurpose <br />passenger vehicle (as defined in 49 CFR 571.3) by an employer <br />unless the motor vehicle is transporting passengers for hire or <br />hazardous materials of a type and quantity that require the motor <br />vehicle to be marked or placarded in accordance with 49 CFR <br />177.823. <br />iii. Employees who submit to drug or alcohol testing conducted by a <br />law enforcement officer must contact their supervisor (or another <br />Company official) immediately and provide the name, badge number <br />and telephone number of the officer who conducted the testing. <br />iv At the Company's discretion, employees who are required to submit <br />to post -accident drug or alcohol testing may be assigned to non - <br />safety -sensitive duties, or placed on non -disciplinary suspension, <br />while awaiting the post -accident test results, <br />c. random: [Ref 382.305] <br />i. The Company is required by DOT regulations to test employees for drugs <br />and alcohol at random and without prior notice. <br />ii. Random tests will be conducted at a minimum rate set forth by FMCSA <br />(see Section 4, Random Testing Program Verification). Selections will be <br />made at least quarterly, but the Company may conduct random testing <br />more frequently and employees may be subject to additional random <br />selections and testing at any time throughout the year. Selections are <br />made by a computer generated random (stochastic) process to ensure <br />that employees cannot be singled out by name or by any other means. <br />iii. Each employee in a random pool will have an equal chance of being <br />selected from their pool during each selection and as a result may be <br />required to submit to a random drug and/or alcohol test several times <br />in the same year. <br />2020 Drug Screens Plus_ All Rights Reserved.
