B-4 PROHIBITED CONDUCT [Ref 382 Subpart B] <br />The following conduct is strictly prohibited: <br />(a) using, being under the influence of, or possessing illegal drugs (any drug <br />listed in 21 CFR 1308 when the drug has been dispensed or used or is <br />in the individual's possession in a manner not approved by the FDA), <br />including a drug prescribed for another person; <br />(b) using or being under the influence of legal drugs whose use can adversely <br />affect the ability of the covered employee to perform his or her job safely <br />[covered employees are required to obtain advice and instructions from <br />the prescribing physician before performing safety -sensitive duties]; <br />(c) manufacturing, selling, buying, soliciting to buy or sell, transporting, or <br />possessing illegal drugs; <br />(d) using [i.e., drinking or swallowing any beverage, liquid mixture or <br />preparation (including any medication), containing alcohol] or being under <br />the influence (i.e., breath alcohol concentration of 0.02 or greater) of <br />alcohol at any time while performing any safety -sensitive function; <br />(e) using alcohol within four (4) hours before performing or being required to <br />perform any safety -sensitive function (e.g., a supervisor whose primary <br />function is not safety -sensitive, but who is required to be available to <br />perform such duties with little or no advance notice). <br />(f) testing positive for drugs (i.e., MRO verified positive) or alcohol <br />(i.e., breath alcohol concentration of 0.04 or greater); <br />(g) refusing to be tested for drugs and/or alcohol or failing to submit to a <br />drug and/or alcohol test as and when directed (as defined in Section B-8, <br />and Appendix B of this policy, and/or in 49 CFR 40.191 & 40.261); <br />(h) violating any DOT regulations or other applicable federal and/or state <br />requirement governing the use of drugs or alcohol; <br />(i) doing anything to obstruct the Company's goals with respect to drugs <br />and alcohol. <br />Special Notices & Conduct Prohibited under Company Authority: <br />(j} Equipment may be randomly inspected for drugs or alcohol and <br />related paraphernalia and all other controlled or illegal items, and <br />covered employees shall have no expectation of privacy concerning <br />their use of such equipment. Discovery of such items will result in <br />termination and prosecution per company policies. In addition: <br />(k) Covered employees may be terminated for parking at a tavern or bar <br />with company equipment when not in the course of business (e.g., <br />delivering, servicing), or for using alcohol or a controlled substance <br />while on company property or in possession of company equipment <br />whether on or off duty at any location. <br />(1) Hemp products may contain substances that can result in a positive <br />test for THC (whether or not THC is listed on a product label, if any). <br />The use of any such product is prohibited. The use of products <br />containing THC for gny reason (including "medical" or "nutritional") <br />or even unknowingly (e.g., "passive ingestion") will not be <br />considered a legitimate medical explanation for a positive drug test. <br />(See: 49 CFR 40.151(f)) <br />(m) Prescription or other use of Marijuana or THC will not be accepted <br />as an explanation for a positive test (see 49 CFR 40.151(e)}.
