REGULAR MEETING AUGUST 26, 2025 179 <br />A RESOLUTION OF THE CITY OF SOUTH BEND, ACTING THROUGH ITS BOARD OF <br />PUBLIC WORKS APPROVING THE TRANSFER OF REAL PROPERTY TO THE SOUTH <br />BEND REDEVELOPMENT COMMISSION <br />WHEREAS, the City of South Bend, acting through its Board of Public Works (the <br />"City") is the owner of certain property identified herein; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, the City, may transfer or exchange property <br />with another governmental entity upon terms and conditions agreed upon by the two (2) <br />entities as evidenced by the adoption of substantially identical resolutions of each entity; <br />and <br />WHEREAS, the South Bend Redevelopment Commission (the "Commission"), the <br />governing body of the South Bend, Indiana, Department of Redevelopment (the <br />"Department") exists and operates under the provisions of I.C. 36-7-14, as amended from <br />time to time (the "Act") and is a body corporate and politic; and <br />WHEREAS, the City desires to the transfer to the Commission certain real property <br />as set forth in Exhibit "A" attached (collectively referred to as the "Property"); and <br />WHEREAS, the Commission desires to accept the transfer of the Property from the <br />City for purposes of redevelopment and will execute a mirroring resolution documenting <br />such desire and; <br />WHEREAS, the Commission is expected to adopt a corresponding resolution <br />consistent with I.C. 36-1-11-8. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF WORKS <br />AS FOLLOWS: <br />1. The transfer of the following described real property situated in St. Joseph <br />County, Indiana: <br />See Exhibit "A" <br />by the City to the Commission, without consideration, shall be, and hereby is, approved and <br />authorized. <br />2. The Assistant Director of Growth & Opportunity for the City of South Bend <br />shall cause the recording of a quit claim deed conveying all the right, title and interest of the <br />South Bend Redevelopment Commission in and to the Property, for the use and benefit of <br />its Department of Redevelopment. <br />3. This Resolution shall be in full force and effect upon its adoption <br />ADOPTED at a meeting of the South Bend Board of Public Works held on August 26, <br />2025, at 227 West Jefferson Boulevard,13t" Floor, South Bend, Indiana 46601. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/ Elizabeth A.
