REGULAR MEETING JULY 22, 2025 148
Mr. Gilot noted a scriveners note on paragraph four (4) of the permit.
Attorney Schmidt stated the item was likely to be tabled as there were some other things going on
that needed straightened out.
PROJECT COMPLETION AFFIDAVITS
Attorney Schmidt wanted to touch on item 8.A: Demolition of 215 Johnson Street with Green
Demolition Contractors, Inc. He stated there was a utilization plan change as there was a shift in
the work that impacted the ability of the W contractor to meet the WBE goals. He added that
engineer Zach Hurst shifted the work to the M subcontractor who exceeded the MBE goals in
excess of about two -hundred percent (200%).
LICENSES AND PERMITS
Mr Gilot asked about item 12.13: Encroachments/Revocable Permits with JDunham & Arnold LLC
for the installation of a New 18' Canvas Storefront Awning. He stated the wording was curious
quoting, "an awning can not project more than three (3) feet over any public right-of-way" and
asked if it was a new zoning code as he has seen many that do not meet that criteria and extend
farther over the right-of-way. He noted that those may be grandfathered into old zoning laws.
President Maradik quoted the comment in the packet reads, "awnings can not project more than
three (3) feet over any public right-of-way and must be at least two (2) feet away from a traveled
roadway." She clarified that the downtown sidewalks tend to be wider, and the two (2) feet from
the traveled roadway may be the higher priority. Mr. Gilot suggested there may be a separate
zoning restriction in the central business district compared to elsewhere. Attorney Schmidt stated
he could look into it.
PRIVILEGE OF THE FLOOR
ADJOURNMENT
There being no further business to come before the Board, President Maradik adjourned the
meeting at 10:47 a.m.
CITY OF SOUTH BEND, INDIANA
BOARD OF PUBLIC WORKS
Elizabeth A.
