ORDINANCE NO. (j-761-'� <br />AN ORDINANCE AMENDING VARIOUS SECTIONS WITHIN <br />CHAPTER 20 ARTICLE 9 OF THE MUNICIPAL CODE OF <br />THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN <br />AS MOBILITY HANDICAPPED PARKING. <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council of the City of South Bend first passed a <br />mobility handicapped parking law in 1978. Since the passage of this <br />law, several concerned citizens have made recommendations to improve <br />it. <br />The Council therefore introduces the following bill to further <br />strengthen this law by including a fine of $20.00 for persons <br />illegally parking in handicapped parking spaces; marking such spaces <br />more clearly and marked as tow away zones; and requiring that all <br />angle parking spaces be a minimum of thirteen feet wide. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City <br />of South Bend, Indiana, as follows: <br />SECTION I. Chapter 20, Article 9, Section 20- 112(d) of the <br />Municipal Code of the City of South Bend, Indiana, is amended to read <br />as follows: <br />(d) Upon the Board's designation of a space for handicapped <br />parking; its respective curb shall be painted blue and a sign shall <br />be installed bearing the words: "HANDICAPPED PARKING ONLY DISABLED <br />LICENSE OR PERMIT REQUIRED ALL OTHERS WILL BE TOWED AWAY AT OWNERS <br />EXPENSE; and the official international wheel chair symbol or a <br />reasonable facsimile thereof. All angle parking spaces so designated <br />shall be at least thirteen (13) feet wide. <br />SECTION II. Chapter 20, Article 9, Section 20- 113(b) of the <br />Municipal Code of the City of South Bend, Indiana, is amended to <br />read as follows: <br />(b) Any motor vehicle found parking in areas designated for <br />the exclusive use of mobility handicapped persons which does not <br />bear a disabled veteran registration plate, a special registration <br />plate, or display a South Bend Handicapped Parking Permit shall be <br />t4:eketed fined Twenty dollars ($20.00) and towed at the owner's expense. - <br />if found to be in violation longer than one (1) hour. Continuing <br />violations under this Section shall constitute a separate offense and <br />be punishable by a separate penalty for each infraction. <br />SECTION III.
