ORDINANCE NO. 6815 -80 <br />AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 5 <br />OF THE MUNICIPAL CODE OF THE CITY OF SOUTH <br />BEND, INDIANA, BY THE ADDITION OF SECTION <br />2 -61 ENTITLED OLDER ADULTS COUNCIL. <br />STATEMENT OF PURPOSE AND INTENT <br />The City of South Bend, Indiana, recognizes the need to increase <br />its awareness of the special problems and needs of the urban older <br />adults and to give proper consideration to those needs and problems <br />while carrying on the affairs of city government. <br />The City of South Bend, Indiana, also recognizes the need to <br />devise and implement a means to utilize the knowledge and experience <br />of South Bend's older adults on behalf of city government in a planned, <br />coordinated, and meaningful manner through an ongoing and effective <br />organization. <br />The City of South Bend, Indiana, believes that the formation of <br />an Older Adults Council would enable the Office of the Mayor, the <br />Common Council and other city officials to more fully utilize the <br />talents, skills, and knowledge of our community's older adult citizens <br />in addressing both the special needs and problems of our older adults, <br />and the needs and problems of all citizens of South Bend. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City <br />of South Bend, Indiana, as follows: <br />SECTION I. Chapter 2, Article 5, of the Municipal Code of the <br />City of South Bend, Indiana, is hereby amended by the addition of new <br />Section 2 -61, which shall read in its entirety as follows: <br />SECTION 2 -61 OLDER ADULTS COUNCIL <br />(a) Legislative Findings. The South Bend Common.Council hereby <br />finds that there is a need to more effectively and efficiently utilize <br />the talents, skills, and knowledge of our community's older adult <br />citizens in addressing the problems and challenges which face our <br />City, not only those which are peculiar to older adults but those <br />which effect all the citizens of South Bend. <br />(b) Establishment. It is hereby declared that the establishment <br />of an Older Adults Council, referred to herein as the "Council ", is <br />in the public interest of the City of South Bend, Indiana. <br />(c) Composition. The Council shall be composed of twenty -one <br />(21) members who are residents of the City of South Bend. Seven <br />( 7) of whom shall be appointed by the Mayor, and fourteen (14) of <br />whom shall be appointed by the Common Council. The Council shall be <br />broadly representative of the community and non - partisan in nature. <br />Membership on the Council shall be limited to older adults, herein <br />defined as persons 55 years old and older. <br />(d) Terms of Members. The members of the Council shall serve <br />three year terms as members, however, the first Council shall have <br />one -third of its membership appointed for a one (1) year term, one - <br />third for a two (2) year term and one -third for a three (3) year term. <br />The first Council shall have five (5) members selected by the Common <br />Council for one year terms, five (5) members selected by the Common <br />Council for two year terms and four (4) members slected by the Common <br />Council for three year terms. The first Council shall have two (2) <br />members selected by the Mayor for one year terms, two (2) members <br />
