i <br />• in order to install electrical lines for the new Holy Cross Corporate offices, as well <br />as for any future development. The easement runs south from Nimtz Parkway, along <br />Mayflower and is in the set-back area from the right-of-way. Ms. Pfotenhauer asked <br />if the easement went under anything that would cause a problem. Mr. Rock stated <br />the right-of--way is in the landscaping area where there would be no problems. <br />Upon a motion by Mr. Alvarez, seconded by Mr. Kahn, and unanimously carried, <br />the Authority approved the AEP request for easement in Blackthorn Corporate Park. <br />b. Authority approval requested for Seventh Addendum to Amended and <br />Restated Lease between the South Bend Redevelopment Authority and the <br />South Bend Redevelopment Commission. <br />Mrs. Kolata stated that the Redevelopment Authority issued bonds several years ago <br />to buy land in the Blackthorn Corporate Park area. The Redevelopment Commission <br />leases the land from the Redevelopment Authority, and as the land is sold, a portion <br />of the .bonds is defeased. This addendum would release the land which was <br />purchased by Holy Cross, as well as the optioned two acres, from the terms of the <br />bond lease... <br />Mr. Alvarez asked what would happen if Holy .Cross chose not to purchase the <br />additional two acres. Mrs. Kolata stated that when the bonds .are paid off, any land <br />remaining unsold will be owned by the Redevelopment Commission. <br />• <br />Upon a motion by Mr. Kahn, seconded by Mr. Alvarez, and unanimously carried, <br />the Authority approved the Seventh Addendum to Amended and Restated Lease <br />between the South Bend Redevelopment Authority and South Bend .Redevelopment <br />Commission dated as of October 1, 1990. <br />c. Authority approval requested for Grant of Non-Buildable Perpetual Easement. <br />The South Bend Chocolate Factory,is leasing and rehabilitating the former CCA <br />building from the Redevelopment Commission. The building was built to the lot <br />line and requires a 20' setback in order to be able to have windows and entrance <br />doors put on the north side of the building. This action will create the 20 foot <br />setback and ensure that nothing will be built in the 20' area on the north side of the <br />CCA building. A sidewalk will be built next to the building, and South Bend <br />Chocolate Factory may also put outside seating and landscaping. in this area. The <br />curb cut on Michigan Street into the Hall of Fame parking lot, will be removed, <br />eliminating one exit for the Hall of Fame parking lot. The Hall of Fame parking lot <br />may also loose a couple of parking spaces, but the Hall of Fame is in support of the <br />project. <br />Upon a motion by Mr. Alvarez, seconded by Mr. Kahn and unanimously carried, the <br />Authority approved the request for non-buildable perpetual easement. <br />• H:\WPDATA\AUTHORTY\071398.bIIN <br />
